Love Marriages in Gujarat may need parents’ nod ? | Bhupendra Patel | Patidar | BJP Constitution

  • last year
In recent news, Gujarat CM Bhupendra Patel has stated that his government will examine the feasibility of making parental approval mandatory in love marriages, provided it is in accordance with the constitution. His remarks came in response to demands from certain sections of the Patidar community, a dominant electoral group in the state, who want parental consent to be a requirement for love marriages.
Hello everyone, this is Zaina Afzal Kutty, and welcome to HW News English.
Addressing an event organized by the Sardar Patel Group, a Patidar community outfit, in Mehsana on Sunday, CM Bhupendra Patel mentioned that State Health Minister Rushikesh Patel suggested studying the instances of girls eloping for marriage. The purpose of this study would be to create a system where parental consent becomes mandatory for such marriages.
In 2022, the influential Patidar community demanded that at least one parent's signature be made mandatory for the registration of a marriage if a girl from the community chooses her partner.
R.P. Patel, the president of Vishv Umiya Dham, a prominent Patidar organization and the convener of the Patidar Organisation Co-ordination Committee, expressed their intention to submit this demand to the State government. He mentioned that the Patidar community is concerned because some girls from the community choose life partners without informing their parents and marry with the help of two witnesses. They observed that such girls are often under pressure, and they also cited instances of 'love jihad' in the past (a term used by certain groups to describe interfaith marriages).
During the ongoing budget session, on March 17, BJP legislator Fatesinh Chauhan and Congress member Geniben Thakor demanded that parents' signatures be made mandatory when adult children choose their partners. They also advocated for marriages to be registered in the same taluka where the man or woman resides. This demand was raised during the Assembly debate on the budgetary allocations of the Legal Department.
The lawmakers pointed out the increasing number of elopements and love marriages by young individuals, which they believe necessitates the government's intervention. They argued that marriages solemnized without parental consent contribute to the crime rate in the State, and they expect that requiring parental consent for such marriages would reduce the crime rate by 50%. Mr. Chauhan, an MLA from Kalol and a prominent face of the Vishwa Hindu Parishad, made this statement.
In 2021, the Gujarat government amended the Gujarat Freedom of Religion Act to penalize forcible or fraudulent religious conversion through marriage. However, this law does not have a specific provision for parental approval.

00:00 In recent news, Gujarat CM Bhupinder Patel had stated that his government will examine
00:05 the feasibility of making parental approval mandatory in love marriages, provided it is
00:10 in accordance with the constitution. His remarks came in response to the demands from a certain
00:15 section of the Partidar community, a dominant electoral group in the state who want parental
00:21 consent to be a requirement for love marriages.
00:24 Hello everyone this is Zainab Zulkati and welcome to HW News English.
00:28 Addressing an event organized by the Sardar Patel group, a Partidar community outfit,
00:34 in Mesana on Sunday, CM Bhupinder Patel mentioned that State Health Minister Rishikesh Patel
00:39 suggested studying the instances of girls eloping for marriage. The purpose of this
00:44 study would be to create a system where parental consent becomes mandatory for such marriages.
00:50 In 2022, the influential Partidar community demanded that at least one parent's signature
00:56 be made mandatory for the registration of the marriage if a girl from the community
01:00 chooses a partner. R.P. Patel, the President of Vishwa Umayadham, a prominent Partidar organization
01:06 and the convener of the Partidar Organization Coordination Committee, expressed their intention
01:11 to submit this demand to the state government. He mentioned that the Partidar community is
01:16 concerned because some girls from the community choose life partners without informing their
01:20 parents and marry with the help of two witnesses. They observed that such girls are often a
01:26 bit under pressure and they also cited instances of 'love jihad' in the past, a term used
01:31 by certain groups to describe interfaith marriages.
01:34 During the ongoing budget session on March 17, BJP legislator Fateh Singh Chauhan and
01:40 Congress member Gennie Ben Thakur demanded that parents' signatures be made mandatory
01:45 when adult children choose their partners. They also advocated for marriages to be registered
01:50 in the same taluka where the man or woman resides. This demand was raised during the
01:56 Assembly debate on the budgetary allocations of the legal department.
02:00 The lawmakers pointed out the increasing number of elopements and love marriages by young
02:05 individuals which they believe necessitates the government's intervention. They argue
02:10 that marriages solemnized without parental consent contribute to the crime rate in the
02:14 state and they expect that requiring parental consent for such marriages would reduce the
02:20 crime rate by 50%.
02:22 Mr Chauhan and MLA from Kalol and a prominent face of the Vishwa Hindu Parishad made this
02:27 statement.
02:28 In 2021, the Gujarat government amended the Gujarat Freedom of Religion Act to penalize
02:33 forcible or fraudulent religious convergence through marriage. However, this law does not
02:39 have a specific provision for parental approval.
02:42 Now I would like to ask the Gujarat government, even if the constitution supports it, why
02:47 consider a study on parental approval for marriages when the legal age for marriage
02:52 in India stands at 21 for men and 18 for women? Currently, there is no constitution requirement
02:58 for parental approval even if the couple meets the legal age criteria and choose to elope.
03:05 Once a person reaches the legal age, not even the constitution can interfere with their
03:10 personal lives. So why is the government attempting to enter someone's personal life and decide
03:15 whom they should marry?
03:17 At the age of 18, individuals in India are granted voting rights. Yet, the Gujarat CM
03:22 is trying to pass a law that requires parental permission for marriage. How is it justified
03:28 to allow someone to vote according to their own will but deny them the freedom to marry
03:32 without parents' consent?
03:35 This potential law is being considered because of the demand from the Patidar community,
03:39 a dominant electoral group in the state. Is the Gujarat government considering this chance
03:44 to secure potential voters for their country? Both the government and Congress are supporting
03:48 this idea. As mentioned earlier, Congress legislator Ms. Thakur along with BJP legislator
03:54 Fateh Singh Chauhan demanded parental consent for adult children to choose their own partners.
03:59 Additionally, in 2019, during a community meeting, Ms. Thakur raised the issue and emphasized
04:05 the need for parents to control their daughters.
04:08 I also want to ask Mr. Rahul Gandhi, is this the new India you speak of? Is this the India
04:15 that believes it is acceptable to let the government intrude into people's hearts and
04:19 lives? If the government and your party members agree on such a law, what sets your party
04:25 apart from all of them?
04:27 We urge you all political leaders to focus on our infrastructure development, our healthcare
04:32 system, and most importantly, our safety, instead of meddling into our personal lives.
04:36 We put our trust in you when we vote, and we hope you prioritize improving our lives
04:41 and the nation.
04:43 That's all for now, for more such news updates follow HW News English. Thank you.
