00:00 former House Oversight Committee Chair
00:01 and a Fox News contributor.
00:02 Jason, it's great to see you.
00:04 We do not know when Weiss will come before the House
00:08 and potentially Senate Judiciary Committees,
00:10 maybe the end of September,
00:12 perhaps the beginning of October.
00:14 But if you were still in Congress
00:15 and you were on that committee,
00:17 what questions would you want to ask Weiss?
00:20 - Well, first thing you need, John,
00:23 is you need to get the documents.
00:25 I'm associated with the Heritage Foundation's
00:28 oversight project.
00:29 They issued a FOIA request.
00:30 We know there are 2,500 pages of communication
00:34 between David Weiss and the Department of Justice
00:37 specific to this plea deal.
00:39 Those documents need to be produced.
00:41 Now, the Department of Justice will take the position that,
00:44 hey, it's an ongoing case, we can't do that.
00:46 But House rules do not recognize that.
00:49 So they should go get those documents.
00:51 It's only from those documents
00:52 can you then press the US Attorney to explain himself,
00:56 explain why did they treat this case
00:59 so differently than previous cases?
01:02 Why do they treat Hunter Biden with such kid gloves?
01:06 What were the prohibitions that David Weiss had
01:09 in pursuing Hunter Biden's case
01:11 outside the realm and geographical location of Delaware?
01:16 There's a lot to ask him.
01:18 - Would you want to know why the sweetheart deal,
01:21 as many people have been calling it,
01:22 was written the way it was, with the immunity clause
01:26 in the gun diversion part of the deal,
01:30 as opposed to in the misdemeanor pleas on the IRS charges?
01:34 And would you also want to know what role, if any,
01:38 the Attorney General Merrick Garland played in this deal?
01:41 - Yeah, I would definitely want to know what the US,
01:45 what the Attorney General knew
01:47 and what was his participation.
01:48 He says he's hands off, but I highly doubt it.
01:51 There is no way with an explosive case like this
01:53 that he was hands off.
01:54 I highly doubt that.
01:56 I want to know about the immunity deal.
01:58 I went through this under the Hillary Clinton case.
02:01 Five times the Department of Justice handed out immunity
02:04 with no requisite that they have to participate
02:08 and help the government.
02:09 So why are you giving out immunity deals
02:11 with no requirement to actually communicate
02:14 and help the government?
02:16 That's usually the trade that comes off of here.
02:18 But yeah, why such a sweetheart deal?
02:20 The gun charge, there is no US attorney
02:23 I've ever interacted with that has ever been
02:25 on this network and others that can tell you
02:27 that that is typical and how they've dealt with this.
02:30 This was sweetheart deal for the Bidens.
02:33 - I want to pivot to the Trump case
02:34 because his attorneys have until five o'clock
02:36 this afternoon to file an objection
02:38 to a protective order that's being sought by Jack Smith.
02:41 If allowed, that protective order would severely limit
02:45 what Trump and his legal team could say
02:47 about the evidence in the case.
02:49 What do you think about the fact that Smith
02:51 is trying to limit what they can say?
02:52 - I mean, that is classic Department of Justice, isn't it?
02:57 It's a first amendment case and they're going to try
03:01 to gag the president of the United States,
03:03 a candidate for the presidency of the United States
03:06 from being able to talk about his own defense
03:09 and his own case.
03:10 Don't tell me that the Department of Justice has been mum.
03:14 They've been out there, every member of Congress,
03:16 everybody in the administration, Joe Biden,
03:18 everybody's been out there talking about Donald Trump
03:21 and how wrong he is.
03:23 The guy gets to defend himself and I would be shocked
03:26 if they tried to put a gag order on Donald Trump
03:30 and his legal team, but it wouldn't surprise me.
03:33 But boy, would that be fundamentally wrong
03:35 in the United States of America.
03:37 - Hey, real quick, Jason.
03:39 We have folks on both sides.
03:40 Some Democrats are asking for this.
03:42 John Lauro, Trump's attorney and other members
03:45 of the Trump legal team are saying there should be cameras
03:47 in the federal courthouse.
03:49 They haven't been allowed for criminal proceedings
03:51 in federal court.
03:52 Should they be in this case?
03:54 - No, no.
03:56 No, it's enough of a clown show.
03:58 I don't think the cameras in the courthouse,
04:01 I like the prohibition on the cameras in federal court
04:05 and at the Supreme Court,
04:06 and I think they should stay in place.
04:08 - All right.
04:09 Well, probably highly unlikely that they would be allowed,
04:11 but what a show it would be.
04:14 We'll see what happens.
04:16 Jason, thank you.
04:17 Appreciate it.
