00:09 Karen, it was very unhinged to say the least, Donald Trump's first day at the civil trial
00:15 brought by the New York Attorney General lashing out, threatening the New York Attorney General
00:21 and the judge before, during lunch and after.
00:26 But that was a direct threat right there.
00:28 I want to get your perspective as a former prosecutor, the former number two at the Manhattan
00:34 District Attorney's Office, is what we just witnessed a crime?
00:39 I certainly think it is.
00:41 He's getting more and more blatant and more and more direct in terms of his threats to
00:48 prosecutors, judges, witnesses, whoever.
00:52 This was the most explicit, I think, direct threat so far, as if holding a baseball bat
00:59 next to Alvin Bragg, the Manhattan DA's head.
01:02 If you recall, Ben, when he posted that picture when he was prosecuted, when the indictment
01:09 came down against him by the Manhattan DA's office and by Alvin Bragg, and he claims,
01:13 "Oh no, I was just talking about an American-made bat," as if we're supposed to believe that.
01:20 But because it was a little bit subtle, it was hard to say that was a direct threat.
01:27 Or when he said on TV that time, "Proud Boys, stand back and stand down or stand by," whatever
01:35 he said, "Stand back and stand by," everyone knew that was a call to action to violence.
01:41 And that culminated in January 6th when he whipped up an armed crowd and literally pointed
01:50 them at the Capitol and told them, each one, every single person has testified or has explicitly
01:56 said, whether it's in sentencing memoranda or wherever, they did it because they understood,
02:01 they knew what his words were, that that's what they wanted him, that's what he wanted
02:06 them to do.
02:07 And so this though, what he just said about the Attorney General of the State of New York,
02:13 Letitia James, he's called her racist, he's called her all sorts of names.
02:19 We've already heard that she has to have 24/7 protection, that there have been death threats
02:24 against her by his supporters.
02:26 But this quote that he just has said on national television, that he has basically told everyone
02:33 to go after this Attorney General, I don't know how you can get any more explicit than
02:40 that.
02:42 And so I think that law enforcement is going to be listening, they're going to know that
02:46 he did this, and they're going to be in heightened, heightened position and posture to protect
02:51 the Attorney General who has been threatened today in the middle of a trial.
02:58 And he's got the microphone, he's standing outside of court, and if any other criminal
03:03 or civil defendant, and I Freudian slip say criminal here, because this is, although it
03:10 is a civil case, it is quasi criminal.
03:13 This is Letitia James as the Attorney General using her enforcement powers to go after Donald
03:21 Trump who is engaging in persistent fraud.
03:26 And so she's doing this on behalf of the State of New York.
03:31 And what she's doing is she's basically saying you can't lie and take money that other people
03:36 can't.
03:37 You know, you can't, business in New York has to be above board, you can't lie to get
03:42 money and then use that money to make more money.
03:45 It's the ultimate Ponzi scheme that he's engaged in that she is bringing against him.
03:51 And if any other defendant in a situation like this were to say you should go after
03:56 a public servant like the Attorney General who is bringing this case against him, especially
04:01 someone who has blood on his hands because his calls to action, his calls to violence
04:07 have been met by his followers, any other criminal defendant would not be allowed to
04:11 get away with that.
04:13 And they'd be put in jail.
04:16 Donald Trump poses a very tricky situation for judges because he's running for president.
04:24 That's his defense, by the way, his defense to all of these charges is, well, I'm running
04:28 for president, you know, so you can't go after me.
04:31 But all of these things were in the works before he decided to run and he's running
04:35 to use that as a defense.

08:18 as a former prosecutor, if that was a criminal defendant, what would be the outcome?

08:33 And so I don't understand it.

08:39 I get that there are other considerations because he's running for president and therefore
08:45 he needs to be given some leeway to continue on.
08:50 But threats is not free speech.
08:52 Threats are violence.

08:56 And it's something that needs to be dealt with.
08:59 At a minimum, a limited gag order.
09:02 But I think potentially it could be other sanctions as well, because the threats, he
09:09 does not have a right to do that.
09:12 And so, as I said, any other defendant would have been put in by now.
09:15 And when I say put in, I mean, he'd be put in jail.
09:18 So he cannot be out there threatening people's lives.
09:22 And we've already seen the violence.
09:25 We've already seen the chaos.
09:28 We've already seen the reaction and the death threats have come, et cetera.

09:35 You could talk about Sheamus and Ruby Freeman, right?
09:38 You could talk about anyone who he calls out by name and criticizes has had their life
09:47 put on the line, has had to move, have had to have security.
09:51 But this one is a direct threat, a quote, "You ought to go after this attorney general."
09:57 I mean, isn't this him explicitly calling to his followers to attack Attorney General

10:06 He then goes on to say that Justice Ngoron is a rogue judge who should be out of office.

10:20 Rather than, by the way, doing it and then sort of calming down and backing off because
10:26 judges have told him to, or his lawyers have told him to, he's escalating.

10:31 As if holding a baseball bat next to the prosecutor, Alvin Bragg's head was not explicit enough.

10:42 This is escalating behavior and escalating conduct and somebody needs to hold him to

10:50 And October 16th will be the hearing before Judge Chutkin.
