00:09 of support. I can give as good as good as I get I know the place of where I'm at I
00:15 didn't get speaker on an easy round it hadn't happened in 150 years it took me
00:19 15 rounds I will never give up I think if people raked how many times they
00:24 would have killed me in the past I would have been dead long ago. Joining us now
00:29 is NBC's Capitol Hill correspondent Ali Vitale and Jacqueline Alimany
00:33 congressional investigations reporter for The Washington Post. Ali to you first
00:37 you're on the Hill there's action behind you we're waiting to hear from House
00:41 Democrats House Republicans after these meetings when might we hear from them
00:44 and what happens next? Definitely an active morning here on the
00:50 Hill on a both Republicans and Democrats have been huddled behind
00:53 closed doors since around 9 o'clock this morning both meetings starting to break
00:57 up a little bit and of course one of the key people who I've been watching for
01:00 standing outside of the House GOP meeting is Congressman Matt Gaetz
01:04 himself the man who is at the center of pushing this motion to vacate against
01:08 Speaker McCarthy in the room two Republican sources told me that
01:12 McCarthy said he was going to put this vote up and let it be on the floor this
01:16 afternoon clearly wasting no time you referenced his defiant tone this morning
01:21 he's confident that he'll be able to remain as speaker nevertheless our
01:25 unofficial whip count just folks we're talking to in the hall gives us five
01:29 Republicans who say that they would vote to oust McCarthy as speaker that means
01:33 he's gonna have to be dipping with Democrats at some point trying to make
01:37 up those margins unless of course the total number of people in this chamber
01:41 at some point changes given the fact that it's coming up today though we
01:44 still expect the numbers to be what we think they are which means we're
01:48 actively also looking at what Democrats are doing and if there have been any
01:52 overtures made nevertheless I want to play for you a brief snippet of what
01:56 Congressman Gaetz said to us leaving this meeting watch
02:00 somebody's been lied to because we heard the president come out and say there was
02:05 a deal with the speaker on Ukraine and the speaker just stood up in front of
02:08 all of us and said that there's no deal on Ukraine the House Democrats say
02:12 there's a deal on Ukraine so we're gonna have to sort that out we're gonna have
02:16 to sort out who's lying and what Gaetz is referencing there is a conversation
02:23 that he's been having with multiple reporters his colleagues he even said
02:26 this on the House floor that he feels that McCarthy shortchanged his
02:30 conference and has not made good on the promises that he made to them when he
02:34 became speaker in the first place in January for instance giving them like 72
02:38 hours to read bills before they vote on them this alleged deal with Ukraine
02:43 which McCarthy says doesn't exist I will say there's two points that I'm looking
02:46 at here the first is that Gaetz told me he thinks Democrats should do this for
02:50 free he said that he has not he didn't say whether or not he's spoken to them
02:53 and the second is you can't replace McCarthy with nobody and I still haven't
02:56 heard a name that's interesting and Jackie McCarthy's projecting confidence
03:01 that he will come out the victor here he mentioned how it took him 15 rounds of
03:06 voting to be elected speaker he's now facing this revolt from inside his party
03:11 is there any indication of how many Republicans Gaetz actually has in his
03:14 corner and if Gaetz doesn't win on this first round do we just expect him to
03:18 keep going and going and going yeah and well as Ali noted the the whip count for
03:25 Republicans who are ultimately going to vote to oust McCarthy is still up in the
03:29 air but that number is seems to be growing and at the end of the day it
03:34 does not seem like McCarthy's going to be able to maintain his job without the
03:38 support of at least a handful of Democrats so we are still very eagerly
03:44 waiting on what Democrats exactly are going to do some have said that they're
03:47 waiting on directions from minority leader Hakeem Jeffries on whether or not
03:53 the house is going to take Democrats are going to take a unified vote here but it
03:58 would be extremely unusual for Democrats to come together the minority to support
04:03 the majority leader the member of the opposing party politically that's
04:07 obviously not the most popular thing to be doing especially in light of some of
04:13 the accusations McCarthy has hurled at Democrats even as they they really in
04:19 their opinion rescued him during an emergency to avoid shutting down the
04:24 government even as McCarthy continued to blame them for a potential shutdown on
04:29 on Sunday shows there's also just other hostile issues underlying tensions that
04:34 run a lot deeper than this situation that McCarthy is in right now ranging
04:40 all the way back to January 6th when McCarthy in in the aftermath of the
04:45 attack on the US Capitol in 2021 went down to Mar-a-Lago and essentially made
04:50 amends with then former president Donald Trump even after the Republican Party
04:56 was sort of slowly potentially turning away from him in you know all this again
05:03 hostility about Trump's role in in promoting the January 6th attack
05:07 Democrats squarely blame McCarthy for bringing him back in to the fold and
05:12 having Republicans rally around him once again and and so I think it's it's hard
05:18 to envision a world here where you're going to get Democrats in mass at least
05:23 to support him so we just learned that the reporting coming out of the
05:28 Democratic meeting is that while Hakeem Jeffries the leader for the Democrats
05:32 had mentioned or at least was expected to speak at some point this morning that
05:36 has been postponed so let's listen to what he told our morning Joe to see if
05:42 that gives us an indication of where things are headed for Democrats take a
05:45 listen we have a caucus meeting this morning we'll have a family
05:50 conversation about this issue relatively a first impression and hasn't been
05:56 before the Congress in 110 years or so and then figure out where to go from
06:01 there Ali what is the calculation for Democrats on how to play this do you
06:07 think that's the open question here is whether or not Democrats are going to
06:13 find some upside to helping save this speakership I've talked to some who are
06:19 in more red or purple districts who say that they have not been approached by
06:23 McCarthy that there's not been much conversation and to the extent that
06:27 we're hearing details come out of the Democratic meeting this morning it's
06:30 clear that most Democrats feel that they are best when they are united and what
06:34 that tells me is that they're not interested in wading into the fray of
06:38 how to save the speaker effectively that really does leave us at an impasse I do
06:43 want to detail just how we think that this afternoon might go because with
06:47 McCarthy saying that this vote would come in the first vote series we expect
06:51 it this afternoon and he might give us more details now let's watch

07:01 you know if I counted how many times someone wanted to knock me out that
07:05 would have been gone a long time ago can you explain a little bit about why do it
07:09 today I mean the idea that you why not rip the band-aid off here or what why
07:14 not you know okay I think Matt has planned this all along it didn't matter
07:18 what we transpired you know he would have done it if we were in shutdown or
07:22 not I firmly believe it's the right decision to keep government open to make
07:27 sure our military is still paid our border agents are still paid and if that
07:31 makes a challenge based upon whether I should be speaker I'll take that fight
07:35 so you're calling yeah what was your conversation like with your Jeffries
07:40 why did you call well I have to talk to Jeffries about a lot of things we we
07:44 talk every every week we talk sometimes during the week we've got some issues
07:49 going on the Bowman I've wanted I always try to let him know what's going to be
07:52 coming to the floor and others my only conversation with Jeffries I've got a
07:56 lot of respect for him you know you guys do whatever you need to do I get
08:02 politics I understand where people are I truly believe though the institution of
08:07 the house at the end of the day if you throw a speaker out that has 99% of
08:14 their conference that kept government open and paid the troops I think we're
08:20 in a really bad place for how we're going to run Congress no I personally
08:28 I'm not do you need their help to remain in leadership no if five if five
08:34 Republicans go with Democrats then I'm out so it's what it's it's weather
08:38 probably so this is a bit of a complex piece of algebra because you don't know
08:43 what the attendance you don't know what the present folks I mean tell me why
08:45 you're so confident based on the mathematical equations because I live in
08:49 America no I know but I mean this is serious it is a serious question have
08:54 you ever okay take the current situation out have you ever come to me on no
08:59 matter what you thought I couldn't solve that I wasn't confident I'm not
09:03 questioning your top but you're asking why I'm confident because who I am and I
09:08 just don't give up so there are obstacles in my life I have fallen many
09:13 times there was a time I was going to be speaker and I couldn't and you guys all
09:17 counted me out I'm speaker I'm the 55th speaker of the house you're confident
09:21 that government was going to shut down you were confident the debt ceiling
09:24 wouldn't get done but each and every time I if it's an obstacle I view it as
09:29 a challenge and we're going to solve the challenge we're gonna get heads okay
09:34 we'll keep watching this and bring you any additional highlights that come from
09:38 these live comments we are watching from the house speaker as he prepares for a
09:43 vote as soon as this afternoon to vacate the speakership that was called by
09:49 congressman Matt Gaetz we just heard him discuss the Democrats role in all of
09:55 this which is really quite interesting given as he mentioned all it takes would
10:00 be all the Democrats and five Republicans to vote to oust him and he
10:05 would be gone and yet he is projecting confidence also saying he has a lot of
10:09 respect for leader Hakeem Jeffries of the Democrats so ladies thank you for
10:14 helping us understand what's happening and please stay close and bring us any
10:18 new details that break during this hour I'll keep a watch on this and now to the
10:23 Delaware courthouse where the president's son Hunter Biden will be
10:26 arraigned at any moment on three counts of felony gun charges stemming from
10:31 October of 2018 when Hunter Biden allegedly lied about his drug use when
10:36 he bought a gun we expect him to plead not guilty to all three counts let's get
10:41 to NBC's Mike Memoli outside that courthouse also with us Harry Littman
10:45 former deputy assistant attorney general and former federal prosecutor Ankhush
10:49 Kodori so Mike set the scene for what we can expect at this hearing today
10:55 well Ana this hearing has now been underway for just under 10 minutes
10:59 judge Christopher Burke is currently reading through some of the facts of the
11:02 case the charges that Hunter Biden is facing and the circumstances that led to
11:06 this this should Ana be a routine hearing but of course we're talking
11:10 about a hearing involving the son of the sitting president of the United States
11:13 and we all remember what happened here just about 10 weeks ago when Hunter
11:16 Biden arrived here intending to plead guilty not just to these three gun
11:20 related charges but also a pair of misdemeanor tax charges that deal fell
11:24 apart under really probing questions of the judge at the time questioning not
11:28 just the terms of the agreement that Hunter Biden's attorneys had reached
11:31 with federal prosecutors but also the way in which it was supposed to be
11:34 executed so we do of course expect Hunter to plead not guilty and then the
11:39 question is when does this go to trial if it goes to trial the judge does have
11:43 some leeway in certain terms of setting a trial date as well as maybe directing
11:48 the parties to try to come up with an alternative here potentially a new plea
11:52 agreement and why is that important Hunter Biden's attorneys are district
11:56 for the state of Delaware and - they face some constitutional questions about
11:59 whether they could even be applied at all and so this will be an interesting
12:05 moment to determine the future at least as it relates to one of the legal clouds
12:08 that are hovering over the son of the president here with just under 400 days
12:12 until Election Day Harry this indictment alleges that Hunter Biden bought a
12:17 firearm quote knowing that he was an unlawful user of and addicted to any
12:23 stimulant narcotic drug and any other controlled substance how serious is this
12:28 well it depends how you think of it it's not serious normally for the Department
12:34 of Justice that is when son this is a crime and when somebody breaks it
12:39 unless they've done something else like committed another crime with the gun
12:43 been a straw purchaser the department as a matter of policy generally doesn't
12:47 bring it so after five years of investigation and a determination to do
12:52 it by diversion it all came undone 10 10 weeks ago and really for nothing that
12:58 Hunter Biden did so it's serious as a heart attack for him now and yet the
13:04 irony is it it's something that normally a Department of Justice wouldn't bring
13:09 but the whole kind of swirling politics of it have now really put a bullseye if
13:15 you will on his head so you know he and there's more to come potentially tax
13:21 charges and even charges involving his 2014 15 business dealings in China so
13:27 he's he's in in the soup very much so now all of a sudden and so on Kush I
13:33 want to get your thoughts about that as well because I have talked to a number
13:36 of lawyers who say it is unusual for someone to face a standalone gun charge
13:40 of this nature would hunter be facing these types of charges if his last name
13:45 wasn't Biden I honestly I don't think so I share mr. Lippmann's assessment of the
13:52 situation here I mean I think this is a case that you know prosecutors would say
13:55 was was overcharged a case that ordinarily might never be charged this
14:01 time he's facing out three counts on what is really a fact pattern that as
14:06 mr. Lippmann said really wouldn't normally be charged as a standalone
14:08 offense now of course this all came undone and rather a sort of spectacular
14:13 fashion but he's not even just facing this I mean the tax charges have yet to
14:18 come prosecutors have said those are forthcoming that's another area where I
14:21 think hunter Biden has a legitimate case to be made that he's being treated kind
14:25 of more harshly than similarly situated people so I think at this point it's
14:31 become kind of hard to deny that he's being singled out now in the scheme of
14:35 things we don't have to be that sympathetic about it he's still the the
14:39 son of the president he may not go to prison when all is said and done that
14:43 remains to be seen but putting this in some context yes it's unusual so Harry
14:49 Hunter wanted this to be done virtually his lawyer saying he was planning to
14:53 plead not guilty and that appearing in person would create an unnecessary
14:57 burden on government resources since he requires Secret Service and this is only
15:01 expected to be a very brief hearing maybe lasting 30 minutes or so but the
15:05 judge here insisted he fly in to appear in person what does that maybe tell you
15:11 about this judge is he trying to send a message you know I think he is and it's
15:16 a message that we're seeing in the Trump cases as well no special treatment in
15:20 the life normally one shows up for an arraignment of course it's very unusual
15:24 situation he's already been arraigned on these charges he understands them this
15:29 is this hearing is actually probably over already so it does feel like quite
15:36 a production for not very much I you know I had the the question is now will
15:42 the judge be fairly stern throughout the trial and this trial could be sort of a
15:48 Donnie Brooke his his lawyer has mentioned that he's going to be
15:53 aggressive based on the plea bargains coming undone totally agree with on
15:57 Coosh you know with what he's saying the problem for hunter is many of the things
16:02 that are anomalous here don't necessarily give rise to solid defenses
16:08 once the charges have been brought this is really about prosecutorial discretion
16:12 and the what I would call that sort of abuse of it hmm uncle how quickly could
16:18 this case move if it goes to trial and is it still possible we heard Mike
16:22 mentioned that his lawyers may still be working on a plea deal could that come
16:26 to fruition even though the first plea deal fell apart so I'll be very keen
16:30 interested to see if we if the judge sets a trial date this is the sort of
16:34 case that could go to trial in a matter of months I mean it's a fairly simple
16:37 fact pattern obviously prosecutors and hunter Biden have been going back and
16:40 forth on this for years he should know the evidence there may be legal issues
16:44 that need to be briefed but that can all happen in the run-up to a trial even just
16:48 a two or three months out in terms of a potential plea deal Mike is right I mean
16:54 it's always possible that another plea deal could come together it may be to
16:57 everyone's benefit including the government and and hunter himself to try
17:01 to come to terms on some sort of resolution this time may be presented in
17:07 a format that the judge actually believes is appropriate or sounder than
17:11 last time that's definitely a very real possibility right now in New York City
17:16 court back in session for the civil fraud trial into Donald Trump's business
17:20 empire here you can see the former president in the courtroom just moments
17:25 ago there will not be cameras in court though for the witness testimony so this
17:29 was again a pool spray shot that they allowed us to come in and get before the
17:33 proceedings got underway today let's bring in NBC News correspondent von

17:44 prosecutor on Kush Kodori so von let's start with what's going to happen today
17:48 what evidence what witnesses can we expect right on I was just looking at
17:53 the witness list here and Donald Bender is back on the stand he is the first
17:57 witness he appeared throughout yesterday afternoon he was Donald Trump's personal
18:02 accountant who was working in the capacity with two key figures from the
18:06 Trump Organization to compile Trump's personal tax returns from 2011 through
18:11 2020 the second witness that we can anticipate most likely this afternoon
18:16 coming to the stand if they get through Donald Bender is the accountant who has
18:21 worked with Donald Trump since then dating back to 2021 his name is Cameron
18:25 Harris he's a CPA at Whitley Penn he is part of their audit team and then the
18:30 big two witnesses to follow this is the witnesses we could expect as soon as
18:35 tomorrow or the scene is correspondent von Hilliard he's outside the courthouse

18:47 start with what's going to happen today what evidence what witnesses can we

19:00 afternoon he was Donald Trump's personal accountant who was working in the
19:05 capacity with two key figures from the Trump Organization to compile Trump's
19:09 personal tax returns from 2011 through 2020 the second witness that we can
19:15 anticipate most likely this afternoon coming to the stand if they get through
19:19 Donald Bender is the accountant who has worked with Donald Trump since then
19:23 dating back to 2021 his name is Cameron Harris he's a CPA at Whitley Penn he is
19:28 part of their audit team and then the big two witnesses to follow this is the
19:35 witnesses we could expect as soon as tomorrow or the back half of this week
19:38 are the controller Jeffrey McConnie as well as the chief financial officer Alan
19:44 Weisselberg both of those individuals are named in this lawsuit as defendants
19:49 and they are important because they have worked for decades now with Donald Trump
19:54 and the Trump Organization and in a separate matter related to state
19:58 charges that found the Trump Organization guilty in December of 2022
20:03 for a 15-year tax fraud scheme both Alan Weisselberg of these threats and
20:09 attacks that have come with the being a part of this case and the president's
20:13 rhetoric or the former president's rhetoric so Vaughn the prosecution
20:17 usually goes first right but how do we know or do we know what Trump's lawyers
20:21 plan to mount in their defense based on perhaps their opening statements
20:24 yesterday do they appear to have a new strategy given the judge has already
20:27 called some of their earlier arguments bogus and said that they amounted to a
20:32 fantasy world right number one we actually have a statement from the judge
20:37 here inside of the courtroom in just the last few minutes which is an important
20:41 aspect because Donald Trump has suggested that the judge in this case
20:45 should go back on his initial summary judgment ruling from last week that
20:50 found him liable for financial fraud from inside the courtroom just a few
20:54 moments ago the judge said we cannot litigate what I said in my summary
20:57 judgment that is what an appeal is for there are a layer of other claims though
21:02 however that Donald Trump's defense team is going to be confronted with over the
21:06 next two to three months here and we heard from his lawyers inside of the
21:09 courtroom yesterday make several arguments number one that the lenders
21:13 never actually lost any money to be brought by the defense but also you
21:16 heard one of his attorneys make the case that nobody in America takes the face
21:21 value of their home for instance and that Americans try to get the most money
21:27 they can and as much money as somebody is willing to pay for it and for the
21:31 case of Donald Trump here you see him inside of this courtroom choosing to be
21:35 here for a second day and for Donald Trump so much of this is taking on
21:39 Letitia James directly and his comments before coming into the courtroom here
21:43 this morning suggesting that she is the fraudulent one and that this is a
21:47 fraudulent case of course it'll be determined by the judge exactly which
21:52 side here is you know the most liable and for Letitia James while others
21:58 including the district attorney Alvin Bragg have sidestepped ever bringing
22:02 this case in front of a judge Letitia James did and it will be on court
22:07 prosecutors to make that case that he is in fact liable of what she's presenting
22:12 to them. So Ann Cush what do you make of how Trump's defense lawyers are handling
22:17 this essentially trying to say that the judge who already said fraud was a fact
22:24 in this case that the judge just got it wrong and they're trying to convince
22:27 them otherwise still? Yeah well I mean look trying to get judges to change
22:32 their opinions you know either if you're in front of them or on appeal it's part
22:35 of everyday lawyering it usually fails in a circumstance like this when the
22:41 judge ruled against you last week as legal strategy though all of this the
22:45 tax against the government railing against the judge calling a criminal and
22:48 all that I mean this is like a bizarro legal strategy it's gonna be very clear
22:51 about this this is not an intelligent thing in the ordinary course for any
22:55 litigant to be doing in front of a court that still holds Trump's fate in its
22:59 hands what I think we're seeing though is a political strategy right presenting
23:04 to his supporters that he'll go in and he'll make a big spectacle of everything
23:08 he'll attack everyone and so this is one of these situations where you know
23:14 Trump's political and legal fortunes are so closely intertwined that his like
23:19 sort of quote-unquote defense of the legal case isn't really much of a
23:21 defense it's more of a political argument. Dave yesterday Trump said it
23:26 was very unfair that he did not get a jury trial this is a bench trial but his
23:30 team could have asked for a jury trial no? Yeah he should have complained to the
23:35 woman sitting next to him Alina Haba his lawyer is the one who forgot to check
23:39 the right box did not request the jury trial I mean and and she's saying well
23:44 oh no it's not my fault well whose fault is it the judge said that the reason why
23:48 this is a bench trial meaning the judge is going to make the decision is because
23:51 no one requested a jury trial so there it is and Trump only has himself to
23:56 blame now on the internet I've been asked can he use that on appeal as an
24:01 ineffective assistance of counsel claim to overturn the verdict on appeal and
24:06 the answer is no because this is a civil trial not a criminal one although he's
24:10 able to sue his lawyers afterwards but right now he's continued to follow the
24:15 breaking news Hunter Biden in court and he just pleaded not guilty to three
24:21 charges related to possessing a gun while addicted to narcotics let's bring
24:25 in NBC's Tom Winter he just ran over to the camera he was in the court Tom walk
24:29 us through what just happened. That's right Anna very straightforward and
24:34 simple hearing quite a difference from what occurred 69 days ago when that now
24:39 infamous plea deal broke down between federal prosecutors and Hunter Biden and
24:43 his attorneys. Hunter Biden came into the courtroom at 956 approximately this
24:48 morning wearing a dark suit white shirt and a tie he sat next to his defense
24:52 counsel including Abby Lowell who's going to be the point defense attorney
24:56 going forward the judge went through a number of the charges that he's facing
25:01 here and it really only goes around and I know you've talked about this one
25:04 specific act or series of events that occurred and it's three charges that are
25:08 tied to that the judge went through that made sure that Biden understood the
25:12 charges against him all very much straightforward what we see on all of
25:15 these different types of initial appearances and then went over
25:19 conditions of his pretrial release which will mirror exactly what he's been out
25:23 on so far that he has to have no gun that he cannot use alcohol he cannot use
25:28 any drugs that are not prescribed to him a by a doctor he has to check in with
25:32 probation interestingly the judge of the magistrate judge overseeing this judge
25:36 Christopher Burke noted that Biden has been drug tested on several occasions
25:41 since that hearing this summer that he has been negative on all of those tests
25:45 and then from there they moved to the arraignment his attorney Abby Lowell
25:48 entering a not guilty on his behalf the judge then asked if there were any
25:53 overriding issues that need to take place before pretrial motions are due on
25:57 November 3rd and the defense counsel Abby Lowell spoke and he said that he
26:03 tends to file two motions to dismiss one that the pretrial diversion agreement on
26:07 this specific judge gun rather gun conduct is in effect that it was signed
26:12 at the time it's an agreement between federal prosecutors the Justice
26:15 Department and Hunter Biden both sides signed it so they believe it's in effect
26:20 and that this indictment and that this potential trial shouldn't even be
26:23 occurring at all so they're gonna they're gonna go for a motion to
26:26 dismiss on that that's widely being been anticipated by legal experts the second
26:31 one is the constitutionality of these charges have been different circuits in
26:34 courts of appeals that have kind of struck down this particular charge as
26:39 constitutional so they do anticipate to bring a motion to dismiss based on that
26:45 Abby Lowell did say that we will be making a motion for an evidentiary
26:49 hearing that is presumed to be tied to that pretrial diversion agreement so we
26:53 should expect to hear a little bit about what at least 100 Biden's defense
26:57 attorneys at the time and possibly his former defense attorney Chris Clark
27:01 believed was the agreement between federal prosecutors and Hunter Biden so
27:06 more to come on that that will be a court hearing that we will have there
27:11 will be testimony at that so I do anticipate certainly a fair amount of
27:16 legal challenges from the Biden side of things prior to even coming close to a
27:20 trial here if that occurs Anna okay so you said November 3rd is the next
27:26 potential trial date or a pre-motion trial date thank you Tom winter for the
27:30 update and back with us as former federal prosecutor on Kush Kodori that
27:35 was a pretty quick hearing any surprises not exactly he pleaded not guilty he
27:41 raised the two issues that he raised I gather that the judge didn't set a trial

28:06 hundred Biden's lawyers want a hearing where his lawyers get to go up on the
28:09 stand and talk about how he was mistreated by federal prosecutors I
28:12 don't know that there will ever be such a hearing the judge may not agree a
28:14 hearing is necessary she may think it's legally irrelevant that agreement was
28:18 never fully executed so you know defense lawyers like lots of things they don't
28:23 always get all of those things the constitutionality argument that one
28:27 might have some more legs the Fifth Circuit has sort of issued a ruling that
28:31 gives under Biden some some arguments there it is a deeply bizarre political
28:36 situation since his father the sitting president has been opposed to these
28:41 Supreme Court rulings that that hunter Biden his son would be using in his
28:44 defense but in terms of like the lay of the land not much of a surprise okay
