The Federal Court has ruled that former prime minister Datuk Seri Najib Razak and his son Datuk Mohd Nazifuddin must settle RM1.69bil and RM37.6 million in unpaid taxes.

00:08 Datuk Mahmoud Nazifuddin, must pay income tax arrears amounting to RM1.69 billion and
00:14 RM37.6 million, respectively, to the Inland Revenue Board.
00:20 The dismissal of the appeal was made by the five-member bench led by Court of Appeal President
00:25 Tan Sri Abang Iskandar Abang Hashim on Monday.
00:28 In reading out the decision, federal court judge Tan Sri Nalini Padmanathan said the
00:33 IRB is levying tax on the appellants in the same manner it does for all citizens of the
00:38 nation.
00:40 She also said there is no evidential basis on the record to support that the appellants
00:44 have been singled out for discriminatory treatment.
00:48 Nalini added that Najib and Nazifuddin can still bring their case for reassessment before
00:53 the Special Commissioners of Income Tax.
00:56 Does that mean they will proceed and the former Prime Minister Najib Razak is now bankrupt
01:02 if he doesn't pay up?
01:05 The answer is obvious.
01:06 Anybody who does not pay up, if you want to, you want to be nasty, without going through
01:11 SCIT.
01:12 See, the whole idea of SCIT, this court itself took note, is to provide the complete hearing

01:21 But if the tax department wants to bankrupt him now, without giving him the full right,
01:29 then what the federal court is saying here becomes completely nonsensical.

01:36 So that's why we want to see what is the full judgment.
01:41 In 2020, two separate High Courts allowed IRB's applications to enter a summary judgment
01:47 to recover more than RM1.7 billion in tax arrears from Najib and Nazifuddin for the
01:53 period between 2011 and 2017.
01:56 Both Najib and Nazifuddin lost their appeals in the Court of Appeal last September to set
