00:00 Will two people from the same sex get married?
00:04 The Supreme Court has a big opinion on this.
00:07 The Supreme Court has also voted against the proposal to allow same-sex marriage to be legalised.
00:13 The Supreme Court has not voted for same-sex marriage.
00:17 The Supreme Court has also voted against legalisation of same-sex marriage.
00:26 The Supreme Court has asked the Central Committee to sign the bill.
00:31 But the Constitutional Court has abandoned the matter.
00:36 The Chief Justice D.Y. Chandrachur Janan has called for a committee to discuss the issue of same-sex marriage.
00:45 The committee will ensure the rights of same-sex couples.
00:50 The Supreme Court has asked the people of the same-sex community to stop the legalisation of same-sex marriage.
00:57 The President of the Bar Association of the Supreme Court, Adish Agarwal, told the INJB.
01:05 As President of the Supreme Court Bar Association, I feel that granting this permission will be very bad.
01:15 This is not in accordance with our system prevalent in India.
01:20 India has a different mentality.
01:24 There are different laws and regulations.
01:26 It would be wrong to make laws for the Supreme Court.
01:33 Because the work of making laws is of the elected Parliament of India.
01:40 The Supreme Court has no interference in the work of the Executive and Legislature.
01:47 Three judges said today that if in a trans couple one identifies as male and one identifies as female,
01:58 then that marriage is recognised by law.
02:01 There is no bar to that marriage.
02:04 There was a judgement called Arun Kumar from the Madras High Court that laid down this principle.
02:09 But today that is now nationally applicable.
02:15 The third thing is that there were very detailed observations given by the Chief Justice with regard to protections to be given to queer couples.
02:27 And throughout the word 'queer' has been used as inclusive of not just same-sex couples but also trans couples.
02:38 And this is very important because it includes non-binary people.
02:44 And there are various aspects of protection under the criminal law that have been very specifically elucidated and take the law forward.
02:53 There were judgements that spoke of the obligation of the state to look at civil union,
03:06 to examine the way in which the relationships of queer couples must be respected and recognised in terms of the various accoutrements to a long and solid relationship.
