00:20 When serving notice to the Secretary-General of Lok Sabha, the bench comprising Justices
00:24 Sanjeev Khanna and Deepankar Dutta noted that one of the key issues to be addressed is the
00:29 court's jurisdiction to review the Lok Sabha's actions.
00:33 The official is required to submit a reply within three weeks and any rejoinder from
00:37 the petitioner must follow within three months thereafter.
00:41 The case is scheduled to be listed in the week beginning March 11, 2024.
00:45 Despite a plea by senior advocate Abhishek Manu Singhvi representing the petitioner to
00:49 permit Mahua Maitra to participate in Lok Sabha proceedings as an interim measure, the
00:54 bench declined, stating that it is not expressing any opinion on the application for interim
00:59 relief at the present juncture.
01:02 Singhvi argued that the only concrete finding against Maitra in the Ethics Committee report
01:06 was that she had unauthorisedly shared the login credentials of her MP portal with third
01:12 parties.
01:13 He contended that there is no rule prohibiting the sharing of login credentials.
01:17 Solicitor General of India Tushar Mehta, appearing for the Lok Sabha Secretary-General, submitted
01:21 that the court cannot interfere with the internal functioning of the legislature.
01:25 Maitra faced expulsion from the Lok Sabha following a determination by the Ethics Panel,
01:31 which concluded that she had shared her parliamentary login details with businessman Darshan Hiranandani
01:35 in return for bribes.
01:36 Maitra, a former Member of Parliament, asserted that she shared her login credentials with
01:41 the businessman solely to have his staff assist in typing out her queries on the Lok Sabha
01:46 portal.
01:47 However, she vehemently denied any involvement in a bribery exchange between them.
01:51 The court ruled that Maitra had not shared her login credentials with the businessman.
