00:00 The government has the power to release Najib Razak from prison under the 1955 Penal Code,

00:09 although the Ministry of Education only reduced the sentence of the former Prime Minister,

00:13 according to the former judge of the Supreme Court, Hamid Sultan Abu Bakar.

00:17 He said that Section 43 of the Penal Code allows the release of prisoners of conscience

00:23 in a lawsuit related to the rules set by the minister.

00:28 The ruling also states that the conditions for the release of any prisoners of conscience

00:32 can be stated in the case file for information that the prison is under the jurisdiction of the Minister of the Interior.

00:39 However, it is said that there is no regulation that allows Najib to be released,

00:43 and because of that, the Minister of Justice may need to create a new regulation for that purpose.

00:50 Najib, 70, was found guilty of 7 charges of abuse of power,

00:55 embezzlement of illegal money and breach of trust involving RM42 million from SRC International,

01:01 the former subsidiary of 1MDB.

01:04 The former Prime Minister was sentenced to 12 years in prison on 23 August 2022

01:10 after the last appeal was rejected by the 5 judges of the Supreme Court,

01:14 headed by the Chief Justice of the country, Tengku Maimun Tuan Mat.
