Florida Supreme Court Case Pending Over Sports Betting

00:03 Okay, so hey, we're back talking about Florida again.
00:05 I know it's been a while, this West Flagler kind of went off into the shadows
00:09 as far as the public eye is concerned, because Hard Rock Bet's been up and
00:12 people are betting in Florida on sports through the Seminole Tribe.
00:16 But West Flagler is battling on here, they're trying to get this stopped somehow.
00:21 They want everybody to be able to bet on sports, not just the tribe.
00:25 I don't know, is this a losing battle, Mike, at this point?
00:27 I don't see the tribe shutting down the sports betting unless they're forced to.
00:31 The Supreme Court, I guess, is now in play here.
00:35 >> Right, Craig, so yeah, they had until, I think it was Wednesday or
00:38 Thursday, to file a writ petition with the US Supreme Court.
00:41 They did so, they are challenging, like you said, the Seminoles with Hard Rock Bet
00:45 have a monopoly through the 2021 Gaming Compact, agreed to with Governor Ron
00:50 DeSantis to have exclusivity to offer sports betting in the state.
00:53 West Flagler and some of the other parimutuals have challenged that,
00:57 they have finally submitted to the Supreme Court.
00:59 I think they're waiting for the state case,
01:01 the state Florida sports betting case to be finalized.
01:05 That said, expanded gandling violates the state constitution.
01:09 That did not happen, but they did file here.
01:10 So we've got a state case, we've got a Supreme Court case.
01:13 It's gonna take the Supreme Court a while to even decide if they wanna hear the case.
01:17 I mean, it could be a year or two, right, before we finally get anything on this,
01:20 assuming the Supreme Court even wants to take this case.
01:22 A couple legal experts I talked to said they don't think that's even gonna be
01:25 the case.
01:26 I think they take like 2% of all repetitions.
01:28 They hear like 70 to 80 cases a year.
01:31 We'll see where this is one of them.
01:31 This is the Indian Gaming Regulatory Act is kind of under fire here.
01:36 West Flagler gave a lot of opinion as to why it's not legal, right,
01:40 what Hard Rock's doing here.
01:42 And I'm sure there's a lot of players that are gonna be watching, right?
01:45 Fandle, DraftKings, BetMGM, Caesars, all the big sports betting operators are gonna
01:49 wanna say they wanna get into Florida, obviously, given the population size,
01:53 right, just like California and Texas.
01:54 But we'll see on this front, it's gonna be a while.
01:57 I'm no John Holden, so I don't wanna give all the legal opinion as to why this
02:00 shouldn't happen.
02:01 But a lot here, the Equal Protection, Indian Gaming Regulatory Act,
02:07 a lot of arguments going on.
02:09 You can read about them in Legal Sports Report with a lot of smarter people than
02:11 me laying out the arguments.
02:14 And so we'll see what happens here.
02:16 But again, an issue that's not going away, and now it's in the court's hands.
02:19 And we'll see on the state case and the Supreme Court case,
02:22 we don't have any dates as to when this stuff's gonna be done.
02:24 But it's definitely gonna take a while.
