" Umeed Hai Supreme Court Is Muamlay Par Somoto Le Gi." Qanooni Mahireen Ki Raye
Transcript
00:00 So now it is very important that this case is taken up by the Supreme Court.
00:05 I am hopeful that this case will be taken up by the Supreme Court and then proper investigation will be done.
00:13 The second thing is that in the Faizabad Dharna judgment it was written that it is very important
00:21 that the secret agencies in the world have checks and balances, they are regulated by the law.
00:33 But in Pakistan, there is no control over our premier intelligence agencies.
00:42 So until you introduce that, I don't think this case will stop.
00:48 Mr. Shaukat Siddiqui, I would like to welcome you.
00:51 Barrister Salahuddin has just mentioned you.
00:53 When you went through this whole process,
00:55 probably out of the six judges who wrote the letter, only one was present in the High Court.
01:00 Not all, six of them.
01:01 How were you isolated and persecuted then?
01:04 Thank you very much.
01:06 When I spoke about this, there were five judges in Islamabad High Court.
01:15 Mr. Amir Farooq, Mr. Mohsin Akhtar Kiani, Ms. Gulhasan Naurangzadeh and Chief Justice Muhammad Anwar Khan Qasid.
01:26 When I spoke about this, all my fellow judges, their attitude towards me was like a social boycott.
01:41 I was completely isolated from them.
01:48 And even then, I felt a formation between them.
01:56 And I faced the legal battle that I fought alone.
02:06 And no one from my High Court supported me.
02:13 What to talk of?
02:15 That they should have a practical statement.
02:19 Mr. Shah Khawar, investigations are ongoing.
02:22 And there are two legal opinions that Suomoto should be taken.
02:26 I think it should be taken.
02:27 It should be taken.
02:28 It should be taken because this case has become very controversial and politicized.
02:33 And you must have seen that there is political goal scoring on social media.
02:39 Which I think is very regrettable and dangerous.
02:43 But Mr. Hamid Khan said that the Supreme Judicial Council makes the Code of Conduct.
02:47 No, it does not.
02:50 In fact, the Code of Conduct was amended in 2009 by the Supreme Judicial Council.
02:55 The Supreme Judicial Council's Code of Conduct is rejected by the judges of the High Court and Supreme Court.
03:02 There is no other opinion in that.
03:04 My point is that the Supreme Judicial Council can investigate the misconduct of the judge when the case is before them.
03:12 And can impeach them and remove them from service.
03:17 My point is that there is no legal and legal provision to refer the judges to the Supreme Judicial Council for guidelines.
03:26 So what should be done?
03:27 I think that we have a law named Contempt of Court Ordinance 2003.
03:34 There are many forms of contempt.
03:40 One is Judicial Contempt.
03:44 In that, if a person comes under the knowledge of the High Court,
03:48 if a person is interfering in the justice system, or in English it is called "obstructing administration of justice",
03:58 then the judges have the power to take action against that person.
04:04 They can issue a notice of contempt and punish them.
04:09 Suppose I am a judge.
04:11 This is a valid point.
04:18 But what if there are cameras in the house, or if the accused are being electrocuted,
04:25 or if there are messages and pressure from the media, then what should be done?
04:29 I think that this is not inappropriate, but a very condemnable thing.
04:35 That they have been taped or arrested.
04:38 Do you believe them?
04:39 But these are serious allegations.
04:41 They must be investigated.
04:43 If these allegations are correct, then they should be brought under the category of justice.
04:51 This is absolutely necessary.
04:52 But another thing, I am talking about obstruction of administration of justice.
04:57 Recently, on March 1, 2024,
05:03 our honourable judge of Islamabad High Court, who is among the six judges who have been charged with this.
05:09 Justice Babar Sattar.
05:11 Yes, Justice Babar Sattar.
05:13 He has given six months, four months and two months of unpaid sentences to Deputy Commissioner of Islamabad,
05:20 SSP Operation Islamabad and SHO Qaussar for obstructing administration of justice.
05:30 So I think that if someone approaches a judge to make a favourable decision,
05:37 or threatens him, creates harassment,
05:41 then they have the option.
05:44 The reason is that they have taken a decision without fear of danger,
05:52 desire and ego.
05:54 So you are saying that the Code of Conduct has the right to do so.
06:00 So this letter has no use.
06:03 I personally think so.
06:04 Because this letter has created a huge controversy.
06:09 There is politics on this.
06:11 So you did not have to write this letter?
06:15 I think that there was no need to write this letter.
06:17 If they had done this in their superior judiciary or even Supreme Court,
06:23 they would have used the legal and legal options that I have mentioned.
