Hi. I'm Indiana personal injury attorney David Holub.

This video clip is prompted by a call from a client.

A physical therapist, spoke with a client, and tried to have him sign a direction to the therapist not to actually bill his insurance carrier.

So here's the issue. People pay premiums for their health insurance benefits.

There's no reason to give up those benefits just because you're involved in a motor vehicle collision.

So what fuels this type of scam?

Well, the problem is providers, in order to advertise that they accept insurance from ABC Insurance Company, basically say they'll take thirty-three cents on the dollar or something comparable, in receipt for whatever services they actually charge. So here's an example.

Suppose the therapist would charge one thousand dollars. They send that bill to the health insurance company, and the health insurance company pays three hundred and thirty dollars.

Well, the physical therapist thinks they're out six hundred and sixty six dollars, forgetting that they actually made an agreement that they would accept the lesser amount of three hundred and thirty dollars.

So they essentially think, now here's a car crash victim. He's going to get an insurance benefit from the third party who actually injured him. So I'll take advantage of that, and I'll try to get my patient by whatever means, tricking them or whatever I can do to get them to sign so that they actually get fully paid a thousand dollars for their services.

This is a scam.

And if you have a physical therapist or a doctor or a chiropractor or anybody who's trying to pull this kind of a scam, I would suggest you fire them and find another therapist or another provider because you can't trust them on anything they're going to do for you physically if they're going to be trying to cheat you, in this manner.

00:00Hi, I'm Indiana Personal Injury Attorney David Hollum.
00:05This video clip is prompted by a call from a client.
00:10A physical therapist spoke with the client and tried to have him sign a direction to
00:21the therapist not to actually bill his insurance carrier.
00:27So here's the issue.
00:29People pay premiums for their health insurance benefits.
00:33There's no reason to give up those benefits just because you're involved in a motor vehicle
00:38collision.
00:41So what fuels this type of scam?
00:44Well, the problem is providers, in order to advertise that they accept insurance from
00:52ABC Insurance Company, enter what's called payback agreements with those insurance carriers.
01:00And those agreements basically say they'll take 33 cents on the dollar or something comparable
01:08in receipt for whatever services they actually charge.
01:14So here's an example.
01:16Suppose the therapist would charge $1,000.
01:20They send that bill to the health insurance company, and the health insurance company
01:25pays $330.
01:27Well, the physical therapist thinks they're out $660, forgetting that they actually made
01:36an agreement that they would accept the lesser amount of $330.
01:42So they essentially think, now here's a car crash victim.
01:47He's going to get an insurance benefit from the third party who actually injured him.
01:53So I'll take advantage of that, and I'll try to get my patient, by whatever means, tricking
01:59them or whatever I can do to get them to sign, so that they actually get fully paid $1,000
02:07for their services.
02:09This is a scam, and if you have a physical therapist or a doctor or a chiropractor or
02:15anybody who's trying to pull this kind of a scam, I would suggest you fire them and
02:22find another therapist or another provider, because you can't trust them on anything they're
02:28going to do for you physically if they're going to be trying to cheat you in this manner.
