00:00The Penang High Court has thrown out two lawsuits to remove Lim Boon Lin as the sole trustee
00:09of Penang's Han Chiang School.
00:12In his judgment delivered on July 10, Justice Kwe Chiu Soon said the Penang Teochew Association
00:18and Penang Han Chiang Associated Chinese Schools Association had no course of action against
00:24Boon Lin.
00:26Kwe said the issues raised in both suits had already been decided on by the court in a
00:31previous action.
00:33As such, the suits were caught by the Res Judicata Principle, which holds that a matter
00:38already decided on its merits cannot be re-litigated.
00:42The court also invalidated PTA's appointment of 14 new trustees, holding that the trust
00:48indenture did not give the association the power to do so.
00:52In April, the Penang High Court dismissed a suit brought by Boon Lin over plans to expand
00:57the school into an education city.
01:00Boon Lin contended that the venture required his approval as he was the sole trustee of
01:06the property on which the school operates.
