00:00This is the story of a driver who tried to stop a motorcyclist on the highway and got hit by a car in the middle of the road.

00:07The Panucala is now calling on the camera to protect the drivers that there is nothing wrong with the accidents that they were involved in.

00:15Tina Panganiban-Perez reported this story to Barangay Saksi Online.

00:21Even though they tried to stop the motorcyclist, the motorcyclist counter-flowed on the highway and hit the car in the middle of the road.

00:29The motorcyclist threw the car and hit the car.

00:32Even though the motorcyclist was in the right direction, the driver was arrested while investigating the case.

00:38This incident is the reason why the Panucalang Defensive Driving Bill was called on the camera.

00:44As somebody who has experienced that, it's so unfair that we take care of each other,

00:49and yet people out there just don't care about their own safety, and the safety of other people.

00:54How can a driver who was involved in an accident not be detained if he can submit evidence,

01:01such as CCTV or dashcam video, to prove that he's not guilty of the accident?

01:08We asked the Kapuso Online about this.

01:11One of them said it's a favor because there are many drivers who are involved in accidents.

01:16Another one said it's a big favor for the driver if he can be detained,

01:20if he can show the actual incident that he's not guilty.

01:24Panucala is watching, another one said.

01:27If this law is passed, motorists and pedestrians will be more careful.

01:32It will be more like that.

01:34Those who are involved in accidents will be punished.

01:40Not everyone who was involved in an accident is guilty.

01:43Those who are guilty should be detained.

01:47Panucala has no say on who will decide if the driver is an identity.

01:52He will talk about it when the camera is on.

01:55Are you also considering giving discretion to MMDA or PNP to decide on the spot

02:04if the person involved in the accident will be detained or not?

02:09Well, it's very tricky because not all vehicular accidents can be treated the same.

02:15For example, what Tina said, there was a counter-flow.

02:19But what if the counter-flow was an emergency?

02:21Even though Panucala's intention is to support the one-rider party list,

02:25it pointed out that the judiciary has the power to change the current system.

02:31In my opinion, it should be the Supreme Court because they have the rules of procedure.

02:35The legislature has no power to impose upon them what their procedure will be.

02:40The Automobile Association of the Philippines also asked,

02:43does a new law really need to be changed

02:46in order for the judiciary and the court to decide if a person will be detained?

02:51Until now, the police have already investigated evidence

02:55that they can not release for a limited time,

02:59which does not mean that the person is already in jail.
