00:13that the Professional Body's annual General Meeting was void.
00:17The former Prime Minister's lawyer Muhammad Farhan Muhammad Shafi, who affirmed an affidavit
00:21for a preliminary objection, stated the Malaysian Bar had no locus to commence the legal action.
00:27He claimed that the Bar's 78th AGM, which passed a motion to file the action, was void,
00:34as it was purportedly conducted without the necessary quorum and thus violated the Legal
00:39Profession Act 1976, rendering it ultra-vires and a breach of statutory duty.
00:46The AGM was held on March 16, where a motion on Najib's pardon was being discussed, but
00:51Muhammad Farhan claimed that there were not enough members in the audience, adding that
00:56in such a situation it was mandatory for the AGM to have been adjourned to the next
01:02day in order to achieve the requisite number of attendees.
01:06Muhammad Farhan also said the Bar had no locus stand die to commence the action as they do
01:11not have any legal or equitable interest in the matter pertaining to Najib's pardon.
01:17On April 26, the Bar filed the application for leave to commence judicial review to challenge
01:23Najib's pardon.
01:25It named the Pardons Board of the Federal Territories of Kuala Lumpur, Labuan, and Putrajaya,
01:31and Najib as the first and second respondents, respectively.
01:35The Bar is seeking a declaration that the January 29 Pardons Board's decision regarding
01:40Najib's application to halve his prison sentence, which would result in an early release on
01:45August 23, 2028, is illegal, unconstitutional, and invalid.
