00:00Working in a fair, supportive environment is all a lot of us want out of life.
00:05Unfortunately, the workplace can sometimes be a place of inequity.
00:09If you're an independent litigant trying to initiate a workplace discrimination case,
00:14you can never be too prepared.
00:16And knowing the ins and outs of workplace discrimination laws
00:19is the first step to getting the fairness you deserve.
00:22It is illegal for an employer anywhere in the country
00:25to discriminate on the basis of sex, race, color, religion,
00:30nationality, age, disability, or marital status.
00:34In Florida, you can add people with AIDS or HIV and sickle cell anemia to the list.
00:39But before a work discrimination claim can be brought to court,
00:43it must first be brought up with the Equal Employment Opportunity Commission,
00:47or EEOC, which is federal,
00:50or with the Florida Commission of Human Resources, or FCHR, which is state,
00:56or with both at the same time.
00:58You have a 365-day time deadline to file with the FCHR
01:02and 300 days to file with the EEOC from the date of discrimination.
01:07If either of the agencies don't resolve the issue,
01:10then and only then can you pursue the claim in court.
01:14A lawsuit making a claim under federal anti-discrimination laws
01:17must be filed within 90 days of a Notice of Right to Sue from the EEOC.
01:23A lawsuit based on the state laws must be filed within one year of the date
01:27the FCHR has issued a probable cause determination
01:32or four years from when the discrimination occurred.
01:35Remember that state law claims can be filed in federal court and vice versa,
01:40and that you can bring both federal and state claims in one case.
01:44Generally, these federal and state laws apply to companies with at least 15 employees,
01:49but some only apply to companies with at least 20 employees,
01:53unless the discrimination is about paying men and women the same salary for equal work.
01:58That law, the Equal Pay Act, applies to all companies of any size.
02:04For other types of discrimination, however,
02:06if you work for a company with less than 20 employees,
02:10it is best to check the law for the type of discrimination that happened to you.
02:14Incidentally, claims can be based on discrimination that is less obvious or blatant,
02:19such as inappropriate interview questions
02:21or position reassignment because of pregnancy, for example.
