Judge Judy told us she had nothing nice to say about the brothers.

00:00As we speak right now, we have learned that the
00:05Deputy District Attorney in L.A. County
00:08and the lawyers for the Menendez brothers
00:11are in chambers with the judge
00:14who is gonna hear the case on whether they get out or not.
00:18And they are, we're told, gonna set a date for a hearing.
00:23And that hearing is gonna be the first time
00:26that Judge Jessup can actually hear the arguments
00:30about whether or not to reduce their sentence.
00:34If he reduces the sentence,
00:35then it just goes to the parole board.
00:37That could take another six months.
00:38But the judge could, because I know Garagos,
00:42we had him on the show yesterday,
00:44Garagos, Mark Garagos, who is the Menendez brothers' lawyer,
00:47he said something that we've already reported,
00:50that he is gonna go into court and say,
00:51look, what we really want is you to reduce
00:54the conviction from murder to manslaughter.
00:56If that happens, the dates that the judge sets,
01:01that could be the date the Menendez brothers
01:03become free men, if it goes their way.
01:05Because the moment the judge says
01:07the conviction is changed,
01:09they'll observe three times the maximum time
01:12for manslaughter, and the gates swing open.
01:15So we're gonna let you know later in the show
01:16if we can get that particular date.
01:19But for now, there are a lot of people weighing in.
01:22We have another judge weighing in.
01:25Well, Judge Jessic is actually meeting with the attorneys.
01:27Judge Judy has an opinion, as you would imagine.
01:30What a shock.
01:31She tends to have opinions.
01:32What a shock.
01:33And she has one about this case,
01:35the case that everyone is waiting to see how it turns out.
01:39Yes, Judy has a very clear opinion
01:42about how she would like to see it turn out.
01:44This is what she said to us yesterday in Beverly Hills.
01:46As a judge, a lot of people are asking
01:49that the Menendez brothers be freed.
01:51I have absolutely nothing to say,
01:55nothing good to say about the Menendez brothers being free.
01:58Well, okay, not hard to read between the lines.
02:00We attempted some follow-up.
02:02She said, nope.
02:03Well, you know what she actually said?
02:05She told the government, you get one question,
02:07and then that was it. And that was yours.
02:09But it's clear what she's saying is
02:11she doesn't want them free.
02:13Now, what's interesting about that
02:14is Judge Judy, before she became a TV judge,
02:17for two decades, she was a family law judge,
02:21and she heard a lot about fractured families
02:24during the course of her tenure.
02:26And so that's what this is, too.
02:29It is a fractured family that we're talking about.
02:31It's a little more complicated than just a fractured family.
02:34Yeah, I think calling this a fractured family
02:37is a little bit of an understatement, Harvey.
02:38This is a premeditated murder case
02:40where two young boys contemplated the murder
02:43of their parents.
02:45And also a molestation, alleged molestations.
02:47And not just molestation,
02:50but there was a lot of testimony in the two trials
02:53about Jose Menendez being incredibly abusive to the kids
02:58and Kitty being a participant in some ways.
03:01So to that point, more than just a fractured family.
03:05But I would imagine that Judy knows
03:07all of those facts also, right?
03:10And she still feels that they should not go free.
03:12Now, people are split on this.
03:14Yeah, people are split, but she is not mincing words here.
03:17And she is a sensible juror.
03:18She's seen a lot of fractured families.
03:19As you said, she was a family law lawyer.
03:21But she wasn't a criminal.
03:22She wasn't a judge in criminal court.
03:24Of course not.
03:25She was not a criminal judge in any way,
03:26but she saw a lot of fractured families.
03:28And I think she thinks it's a waste of time
03:29to revisit this case.
03:30It seems to be politically motivated by George Gascon.
03:32There's just a lot that seems stinky
03:34about looking at the Menendez brothers once again.
03:37But the one thing you gotta know is
03:39that everybody is talking about this is the DA
03:41trying to save his position as DA
03:44because the election's coming up Tuesday.
03:45I said it last week.
03:46I don't know that it's going to save him.
03:48But if he's thinking that, it could be the exact opposite.
03:51It could be the opposite, and maybe he knows
03:53he's gonna lose and he's just doing it anyway.
03:55But the reality is that the Menendez brothers' lawyers
03:59have been trying for 18 months to make this happen.
04:04So it's not like it's a new thing.
04:06The DA jumped on the bandwagon.
04:07The DA moved it up so that it would become
04:11a public thing before the election.
04:13And the Ryan Murphy miniseries has certainly
04:16brought it back into the public fold.
04:17That should not be relevant.
04:19It should not, but it is.
04:21And even George Gascon said as much.
04:23It's been brought back into the limelight.
04:24It's alarming.
04:25It is alarming because the public should not,
04:30DAs should not take their cue from how the public feels
04:34when it comes to sentencing, trying people.
04:38Then it becomes like a public lynch mob.
04:40And that's what's going on all over the country.
04:43DAs are running for election based on
04:45who they're gonna prosecute.
04:47That shouldn't be the case.
04:48DAs shouldn't be looking at TV shows and saying,
04:51oh, well, there's a lot of public interest in it.
04:53They should be basing it on the case.
04:55I have a real problem with this.
04:58You and I are in 100% agreement on this,
05:00but it is starting to look like a fait accompli
05:01because even Governor Newsom said
05:04there are two avenues where he can look at it.
05:06They filed clemency petitions with him.
05:07He can also look at the parole board's recommendation,
05:10and he seems favorably inclined.
05:11So I do think this might happen.
05:13This is Barb from Connecticut,
05:15and I don't agree with Judge Judy.
05:17I think that the Menendez brothers should be freed.
05:20I'm really curious to know more about why she feels that way
05:24because I do love and respect Judge Judy.
05:27And I think she looked great there in that outfit,
05:30but I don't know why.

05:34I don't know why she feels that way,
05:37and I wish she would have elaborated a lot more.
05:39Oh, I do.
05:40She is big into accountability,
05:43and look, I know her,
05:46and I'm just gonna guess this,
05:48that the reloading of the gun and going back to Kitty.
05:52It's premeditation to the next level.
05:53It does, and I have a feeling that is impactful to Judy,
05:58and also that there are plenty of cases
06:00where kids are in real dire circumstances,
06:03and they don't resort to that,
06:04and I think that's probably where her head is on this.
