The Kuala Lumpur High Court has given a discharge not amounting to an acquittal (DNAA) to former prime minister Datuk Seri Najib Razak and former treasury secretary-general Tan Sri Mohd Irwan Serigar Abdullah in the RM6.6bil criminal breach of trust case linked to payments to the International Petroleum Investment Company (Ipic).

00:25In his brief decision on Wednesday, Justice Mohammad Jameel Hussain said he allowed a
00:30notice of motion filed by Najib and Mohammad Irwan's defence lawyers for the two to be
00:36given a D.N.A.A. on grounds that the prosecution did not comply with the Criminal Procedure
00:41Code C.P.C.
00:43He said there had been an inordinate delay in the case that began in 2018 despite hearing
00:49dates being fixed several times.
00:52The court noted that the prosecution failed to adhere to Section 51A of the Code of Criminal
00:58Procedure which requires the prosecution to provide the accused with certain documents
01:03before the commencement of a trial.
01:06Justice Mohammad Jameel then made the order for both accused to be given a D.N.A.A. from
01:11all six charges.
01:13He added that the D.N.A.A. order does not prejudice the prosecution's case and the
01:18prosecution could still recharge them again.
01:21He also ordered for the bail money to be returned to the accused.
01:25Najib and Mohammad Irwan had each paid a one million ringgit bail in the case.
