00:00The Industrial Court ruled that there was no just cause to dismiss former Deputy General
00:06Manager Tengku Kamaru Hisham Kamarudin from THP Bina Sindram Berhad.
00:11The Industrial Court ordered THP Bina, a construction subsidiary of Tabung Haji, to pay Tengku Kamaru
00:16Hisham RM578,460 including 24 months back wages and compensation for his 10 years of
00:23service.
00:25The dismissal followed an anonymous letter alleging misconduct and misappropriation,
00:29namely accusations that fines meant to be deducted from contractors' progress payment
00:34claims were instead paid in cash to health, safety and environment officers.
00:38However, company witnesses had agreed that there were no written procedures on how these
00:43collected fines could be utilized and that the money was used for higher riot celebrations
00:48in 2013 and 2014 with the contractor's consent.
00:52The court found Tengku Kamaru Hisham's dismissal baseless as there was no guideline or SOP
00:57on the usage of the fines collected at that time.
