00:00The court in Pasay ordered the immediate release of Nery Naig Miranda

00:06following his defamation in the arrest warrant against the actress

00:10for the case of syndicated estafa because she did not comply with the due process.

00:22Now is the last day in the hospital of the actress and businessman, Nery Naig Miranda

00:27before returning to Pasay City Jail where she was jailed for the case of syndicated estafa.

00:33But instead of returning to jail, the court ordered her to be released.

00:38Now, December 4, 2024, Wednesday, the BJMP Pasay City Jail received the release order

00:46of Nery Naig Miranda for her case of syndicated estafa in RTC Branch 112, Pasay City.

00:55We were ordered to immediately release Ms. Miranda.

00:59As part of the standard operating procedure,

01:02the verification of the Bureau of Jail Management and Penology was carried out

01:06if there are other cases and warrant of arrest before Nery Naig Miranda is released

01:11who was confined here in the hospital for a few days.

01:14The release of Nery is under the order of Acting Presiding Judge Ronald Agustan

01:20in front of the disposal of the warrant of arrest that was issued on September 17, 2024 against her.

01:27Because of this, the warrant of arrest against her is no longer valid so she needs to be released.

01:33The court ordered the prosecution not to inform Nery about the preliminary investigation

01:39of the Office of the City Prosecutor of Pasay against her

01:43even though a subpoena has been issued for her to be sent to the wrong address.

01:48She will be removed from the NLB and not from the true address of Nery to Alfonso Cavite.

01:53Because the actress was not notified,

01:55this is a clear violation of her constitutional right to due process

02:00that she lost her visa in the preliminary investigation of the Pasay City Prosecutor's Office.

02:05The court also ordered the Office of the City Prosecutor of Pasay

02:10to conduct a new preliminary investigation against Nery

02:14but the court did not grant Nery's request to close the case.

02:18In the statement issued by Nery's lawyer,

02:21he thanked the court for giving importance to his constitutional right to due process.

02:28The next investigation into the case will give Nery a chance to answer the allegations against her.

02:36They hope that the reinvestigation will give Nery a chance to absorb the evidence against her

02:42regarding the case related to Dermacare.

02:45According to the complainant's lawyer,

02:47the facts remain that the case is still the same.

02:51That's why the judge did not nullify the information he gave based on the fiscal resolution.
