00:00Nery Naig Miranda has been released after the court trashed the arrest warrant against her.

00:06But the court did not grant her the right to file a case of syndicated estafa.

00:16Today, December 4, Wednesday, we received around 10am the release order of Nerysa Miranda.

00:27We will release her after clearing.

00:29The actress and businessman Nery Naig returned to Pasay City Jail Female Dormitory after 5 days in the hospital due to medical evaluation.

00:39But earlier, the court ordered her to be released.

00:42When the Bureau of Jail Management and Penology verified that there is no other warrant of arrest against Nery Naig Miranda,

00:49she was released and allowed to leave the hospital where she was confined for a few days.

00:55According to the BJMP, the release order was served around 6 p.m.

01:01Nery's lawyer also confirmed that she was released from the hospital.

01:05According to the order of the acting presiding judge, Ronald August Tan,

01:09the warrant of arrest against Nery was trashed at the beginning of September 17, 2024.

01:15The office of the city prosecutor of Pasay did not inform Nery about the preliminary investigation against her.

01:23Although the court issued the warrant, it was sent to the wrong address.

01:28Instead of sending Nery's real address to Alfonso Cavite, it was sent to Batangas.

01:33Because the actress was not notified, it clearly violates her constitutional right to due process

01:40of not having a visa for the preliminary investigation of the Pasay City Prosecutor's Office.

01:46The court also ordered the office of the city prosecutor of Pasay to conduct a new preliminary investigation against Nery.

01:53But the court did not grant Nery's request to proceed with the case.

01:58In the statement issued by Nery's lawyer,

02:01they thanked the court for giving importance to her constitutional right to due process.

02:08The preliminary investigation of the case will give Nery a chance to answer the allegations against her.

02:15They hope that the reinvestigation will give Nery a chance to absolve herself of the charges against her,

02:21as well as the case related to Dermacare.

02:25The court's decision was not surprised by the complaints, according to their lawyer.

02:30The facts remain.

02:33The case is still the same.

02:35That's why the judge did not nullify the information he gave based on the fiscal resolution.
