00:00Tomorrow, President Bongbong Marcos signed the 2025 National Budget or General Appropriations Act.
00:07But it will not continue because the President has some vetoes.
00:11We have the first news, Ma'am Gonzales.
00:17President Bongbong Marcos appointed members of his Cabinet as Executive Secretaries,
00:23Secretaries of Budget, Finance, Public Works, and National Economic Development Authority.
00:28The General Appropriations Act, the 2025 National Budget.
00:32On Friday, he was supposed to sign the budget.
00:34But Executive Secretary Lucas Bersamin said that it will not continue because it needs time for a thorough review.
00:41It is not yet clear when the budget will be signed.
00:44But Bersamin signed that there are parts that will be vetoed.
00:47The leaders of the House and Senate have no objection to this because this is part of the process.
00:53Under Article 6, Section 27 of the 1987 Constitution,
00:57the President has the power to veto any law passed by the Congress.
01:02Under the Constitution, the President can veto particular items or just a part of the budget.
01:08As of now, the Bicameral Conference Committee passed a budget of almost Php 215 billion
01:15that was added to the budget of the DPWH compared to what was included in the National Expenditure Program
01:20or the proposed budget approved by the Executive.
01:23More than Php 17 billion was added to the camera
01:26and more than Php 1 billion was added to the Senate.
01:29Also, more than Php 11 billion was added to the budget of the DepEd
01:33and the removal of the PhilHealth subsidy.
01:36The Php 26 billion budget for the Ayuda para sa Kapos Angkita Program or ACAP
01:42that was removed from the Senate version but was returned to the Bicam.
01:45According to the law expert Professor Dan Gatmaitan,
01:48removing a particular item is what the President can do.
01:52He cannot transfer it to another part of the budget that was removed from other programs.
01:56For example, if the President vetoed the fund for ACAP,
02:00the fund that was included here cannot be spent even in other programs.
02:04The money will remain in the National Treasury.
02:06If the PhilHealth budget is vetoed and the subsidy is zero,
02:10the original allocation of Php 74 billion will not be returned.
02:14Congress has to respond.
02:16I don't know.
02:17Next time or next year, they will be more careful or special appropriations will be needed.
02:25Eventually, if it looks like money is really needed for certain things,
02:29there will be emergency mechanisms.
02:32Under the 1987 Constitution, the President's veto can still be overrided or the Congress' visa can be revoked.
02:39But this has not happened in history, according to Senate Minority Leader Coco Pimentel.
02:44The Congress can still insist that it needs to be a law.
02:51It can insist by two-thirds vote of Congress per house,
02:57voting separately to override the veto.
03:01No, because a super majority, a special majority is needed.
03:08More than just a simple majority.
03:11Of course, the President's allies are in the House and Senate.
03:16So it should not happen.
03:18The President can also reconvene the Bicameral Conference Committee to fix the budget.
03:23What he needs to do is prevail upon Congress to withdraw their bill to the President so that they can fix it.
03:36That's what I think is the most viable solution here without making the President veto the entire budget.
03:47According to the Senate President, the Condo can be augmented or added after the budget is passed.
