An elderly man who stabbed his wife to death has been declared mentally unfit to stand trial. Today’s court judgement means 93-year-old Francesco Dimasi has been found not guilty of murder, despite the court earlier hearing 85-year-old Marian Dimasi was stabbed 76 times.

00:15The children of Francesco and Maria Demarcy speaking after their father was found unfit
00:20to stand trial for his wife's murder and therefore not guilty.
00:24The court previously heard that Mrs Demarcy was stabbed 76 times in her Finden home in
00:28December 2023.
00:30Today Justice Sandy MacDonald revealed that Demarcy was found by police next to an empty
00:35bottle of spirits and was estimated to have a blood alcohol concentration of up to 0.3%.
00:41It was then agreed he committed an act which tore his family apart.
00:45We grieve our mother immensely and I can only say that we can't forgive the evil act that
00:56took place.
00:57A psychiatric report commissioned by the court found that Demarcy, who has since been diagnosed
01:01with dementia, is now mentally unfit to stand trial.
01:05But the report's author did express the view that Demarcy was mentally competent when he
01:10committed the act in 2023.
01:12This has proven without a doubt that it was not, it was intended and it was done so knowingly.
01:21As a part of the not guilty verdict, Demarcy is now liable for supervision, with the judge
01:26imposing that sentence until the end of his life.
01:29That was no comfort to his children, who continue to mourn their beloved mother.

01:41All four of Mr and Mrs Demarcy's children will have the chance to share the impact that
01:45their mother's death has had on them when the matter returns to court in April.
