00:00To understand the impeachment process of Vice President Sara Duterte, we talked to an expert on the law.
00:06We have with us the Philippine Bar Association Committee on Public Issues and Public Relations member
00:11and Constitutional Law Assistant Professor Paolo Tamase.
00:14Good morning and welcome to Balitang Hali.
00:18Good morning to you too.
00:20What is your first reaction to what happened yesterday regarding the impeachment of Vice President Sara Duterte, sir?
00:28Of course, what was surprising was the continuation of the impeachment against Vice President Duterte.
00:35We know that several complaints were filed in the Congress in the past few months,
00:42but there was nothing to do with those complaints.
00:47So when it continued yesterday, even the lawyers were surprised by what happened.
00:52But please explain to us the process of impeachment because some are asking,
00:57of course, he is the Vice President, what will happen to his work as a vice while an impeachment trial is being conducted against him?
01:08So when an official is impeached, he is not yet removed from his position.
01:14He is given a chance to defend himself when there is a trial in the Senate.
01:21So because the trial is not yet continuing and the Senate is not yet making a decision,
01:27Vice President Duterte is still the vice president and he will continue his duties in the government.
01:33I see. Okay. And the Senate session adjourned yesterday.
01:37Some are saying that they can convene immediately if the Senate impeachment court wants to.
01:45What are the pros and cons of this if they will return to the session before the elections or after?
01:54So as an academic, the Senate's duty to decide on the impeachment complaint,
02:04not because it is recessed, they cannot decide because the Senate is not doing it legislatively
02:11if they are filing impeachment cases.
02:14There are pros and cons, but those pros and cons are political.
02:18Of course, it has an effect on the upcoming election,
02:22and it may also affect the upcoming election, the decision of the Senate if they will continue the impeachment.
02:28Okay. And after the elections, you mentioned that it is possible for the congressmen to change,
02:33the prosecutors and the senator judge.
02:36What will happen if the impeachment trial is changed to the new regular session of Congress, sir?
02:44So to be frank, it is not clear in the current law what will happen if the impeachment is passed on June 30.
02:53This is the opinion of the academics.
02:55In my opinion, I think the trial should also be finished on June 30 because the Congress is changing
03:02when it comes to June 30. The Senate is changing its seats.
03:06So the pending business in the Senate and the House cannot pass by the Congress
03:12including the impeachment.
03:14All right. Thank you very much for your insights about the impeachment. Thank you.
03:19Thank you too.
03:20That was Assistant Professor Paolo Tamasin of the Philippine Bar Association.
