A Delhi court, in a bail order released on Friday, acknowledged the seriousness of the allegations against Brij Bhushan Sharan Singh, the outgoing Wrestling Federation of India (WFI) chief, and Vinod Tomar, the suspended WFI assistant secretary. Both are BJP MPs and were accused of sexual harassment by six women wrestlers. Despite the seriousness of the allegations, the court stated that it would not serve any purpose to take them into custody at this stage.

Additional Chief Metropolitan Magistrate (ACMM) Harjeet Singh Jaspal of Rouse Avenue court granted bail to Mr. Singh and Mr. Tomar on Thursday. The court referred to Article 21 of the Constitution, emphasizing that detaining undertrial prisoners indefinitely would violate their personal liberty. The Delhi Police, which filed the chargesheet, did not oppose or support the bail application.

The court warned the accused not to leave the country without prior permission from the court and also cautioned them against directly or indirectly threatening or influencing the complainants and witnesses.

Citing a previous judgment in the case of Satender Kumar Antil vs. CBI (2022), the court mentioned that the Supreme Court has strongly advocated personal liberty and directed subordinate courts to follow bail guidelines. It noted that when an accused has cooperated with the investigation and the chargesheet has been filed without arrest, it is not mandatory for the trial court to take the accused into custody, and bail should be decided on merit.

02:31 You see, the point is when you see a sexual molestation or sexual harassment accused,
02:41 walking free, laughing out there, when you see people like Ram Rahim who are rapist,
02:49 getting parole after parole and enjoying his birthday,
02:57 you give birth to 10 new rapists in this country. We give birth to 10 new rapists in this country.
03:04 Because if a rapist is not punished, if the rapist is celebrating his birthday at home,
03:10 that is okay, isn't it? The message we are sending to the society, it is okay.
03:16 Is that the message that we intend to send? Till such time that our society, our judiciary,
03:26 our government does not impose serious punishment on rape and on sexual molestation,
03:34 unless and until we do that, unless and until we create the fear of God
03:38 on those people who have these deviant intentions, unless and until we do that,
03:46 rape is not going to stop in India. Rape is not going to stop in India. This is going to be rampant.
03:52 And that is the point I wanted to make. And as far as this case is concerned, this case of
03:58 accused sexual molestation by MP, Bharatiya Janata Party MP of Uttar Pradesh, what is sad is
04:06 that an additional public prosecutor did not even oppose his bail, did not even oppose his bail.
