00:24 This is the big question that is written in the letter that is placed in front of Viva Home States of the Division.

00:36 The residents are afraid of demolishing their homes.
00:42 Even though most of them are already fully paid through Pag-ibig.
00:48 There was a problem through Pagstone Development Corporation, the company that is now in charge of their land and the developers of the subdivision.
00:59 According to the head of Pag-ibig Fund, it was only in 2007 when they learned of the situation.
01:06 They immediately contacted Pagstone along with the developer, Vical Realty Corporation.
01:12 We had a meeting. That meeting is called tripartite memorandum of agreement that was approved by the court.
01:22 The solution to that meeting was that Pag-ibig Fund will let Pagstone borrow P20 million to transfer the land to Pag-ibig Fund borrowers.
01:35 But in 2015, Pagstone cancelled the agreement and removed the three developers, Vical, Hightone Marketing Corporation, and Top Rate Construction and General Services Corporation.
01:51 Because of this, a motion was filed to intervene on Pag-ibig, which lasted for several years, until the Supreme Court.
01:59 After several years, in 2021, the Supreme Court has arrived.
02:06 The Supreme Court admitted that Pag-ibig Fund has no legal standing.
02:11 That means you are not allowed to join the case.
02:15 Pag-ibig Fund has not stopped since November 2020.
02:19 Until now, they are still in contact with the homeowners of the subdivision.
02:24 They will continue to send demand letters to Pagstone.
02:29 In fact, according to Pag-ibig, their last letter was this January.
02:33 We told Pagstone, even if the Supreme Court said that we are not allowed to quote unquote "nor allow" that Pag-ibig Fund has no legal standing,
02:44 we still have 20 million pesos and you need to transfer it to Pag-ibig Fund borrowers according to our tripartite MOA.
02:57 Pagstone answered. Pagstone said that they don't have copies of the contracts and agreements.

03:05 What we did was we sent all the signed agreements, but after that, we did not hear anything from Pagstone.
03:16 They also did not respond to the documents held by Vical.
03:21 In 1997, Vical showed his title, the landowner.
03:28 We inspected the title and it is clean.
03:32 It means that there is no fraud.
03:35 Pag-ibig Fund trusted us.
03:37 The banks were also right, that's why we borrowed.
03:40 For now, the court has given a month's notice to the residents of Viva Home State Subdivision.
