00:13 Today, a very big decision is coming from the Supreme Court of Pakistan.
00:17 It is a Friday and most of the big decisions come on Friday.
00:21 The Supreme Court has passed the Review of Judgments and Orders Act, which you may remember.
00:27 The decision has been passed and the three member bench has unanimously passed it.
00:32 We will talk about it in detail.
00:34 Sardar Lateef Khosla is with us.
00:37 I, Hassan Ayub and Juhay Chaudhary Ghulam Sahin are present.
00:41 But the first story, you know, is that the only question being asked all across Pakistan is
00:48 who will become the next Prime Minister or who will become the millionaire.
00:53 Mr. Chaudhary has said that he has a story and will tell you in the coming days.

05:43 can the Parliament change the principle of the new constitution
05:46 by the general legislation,
05:48 under Article 188 of the Constitution?
05:51 If such a method is allowed,
05:54 then through the legislation,
05:56 the door to intervention in the freedom of justice has been opened,
05:59 which the Constitution prohibits.
06:01 And in the second paragraph, 45, it is said that
06:04 in the current matter, we have reached the conclusion that
06:06 the Parliament did not have the right to legislate on Article 188.
06:11 As it has done through the Review Act 2023,
06:15 where the right to make such rules is used by the court,
06:20 there, in the name of increasing the jurisdiction of the Supreme Court,
06:23 any legislation is undoubtedly an illegal act.
06:27 Now, Khosrow, coming to you,
06:29 please explain this decision to people,
06:33 and also explain to us,
06:35 that what is your view on the Supreme Court's decision,

07:07 when the concurrent list was terminated in the 18th amendment,
07:11 and only a federal legislative list was kept in the constitution,
07:16 then its schedule, its second schedule,
07:20 in that, on item number 55,
07:23 it is written that
07:26 except the Supreme Court,
07:29 that is, the Supreme Court was excluded,
07:32 the practice and procedure of other courts,
07:36 or the legislation can be made about it,
07:38 to that extent.
07:40 But in item number 55, the Supreme Court was excluded,
07:44 because the Supreme Court,
07:46 in its own rules and regulations,
07:48 that is, the Supreme Court rules of 1980,
07:51 Article 191,
07:53 constitutional power,
07:55 the same powers,
07:57 the Supreme Court has made its rules,
08:00 in which they have also done it on the Suvamoto jurisdiction,
08:04 that who will constitute it,
08:07 that is, the Chief Justice will do it.
08:09 And the second thing is that
08:11 what will be the scope of Article 188,
08:14 in criminal, there is error floating on the surface of the record,
08:18 and in civil, there is CPC,
08:20 which is 47, Order 47,
08:23 its own, its own jurisdiction,
08:27 the review has gone to the second eye.
08:29 The second eye can never be an appeal,
08:32 because the appeal is open to facts and law,
08:36 and it is continuous,
08:38 it is a continuity of proceeding,
08:40 the jurisdiction of the review is very limited,
08:44 and the same judge listens in the review,
08:46 and the same lawyer can argue,
08:48 and something that has not come to light,
08:52 and the court and the court,
08:54 despite not having a signature on it,
08:57 can be reviewed on the basis of new and fresh ground.

13:17 in 30 days,
13:18 for its review,
13:20 and its scope has been told,
13:22 that its scope will be equal to the appeal.
13:25 That is, the scope of the review of article 188
13:29 will be equal to article 185(3).
13:33 This is a very interesting thing,
13:35 which the Supreme Court has made a big statement about.
13:38 And, they said,
13:39 "Brother, how are you following article 188,
13:43 and article 185(3),
13:45 that these are both independent constitutional provisions,
13:49 how are you annihilating them,
13:51 merging them,
13:52 and bringing them under each other,
13:54 this cannot be done through any legal system.
13:57 In this, you will have to amend the constitution.
