00:00 Legal action will be taken against the employer responsible for the foreign workers involved
00:08 in the collapse at the Payang Lepas construction site.
00:12 The social security organisation SOCSO in a statement on Thursday quoted Human Resources
00:18 Minister V Sivakumar, saying that legal action would be taken through the organisation as
00:24 five of the nine workers did not have records with the organisation nor contributed to it.
00:32 SOCSO said this was a clear contravention of Section 6 of the Employees' Social Security
00:38 Act 1969 Act 4 and added that according to Section 94 of the same law, employers who
00:46 fail to register and contribute for foreign workers can be prosecuted.
00:52 He said that those found guilty can face a fine of RM10,000, two years in jail or both
00:58 upon conviction, adding that Sivakumar has said that his ministry would not compromise
01:03 on employers who do not register and pay their foreign workers' contributions.
01:09 All foreign workers, including those who serve as labourers in the construction sector, are
01:15 required to register and contribute to SOCSO, effective January 1, 2020.
01:22 On this, SOCSO said the reviews of the two foreign workers who were killed and the two
01:26 who were injured in the construction site collapse showed that while they were registered
01:31 with SOCSO, no contributions were made from 2020 to July 2023.
01:38 It added that the other foreign worker who died had no record of registration and contribution
01:43 with SOCSO.
01:45 The Human Resources Ministry through SOCSO is still actively conducting a review with
01:50 the Fire and Rescue Department, the Bangladesh High Commission in Penang and other related
01:56 agencies over the matter.
01:59 On Tuesday night, a building under construction collapsed in Patumau, near Bayang Lepas in
02:04 Penang.
02:06 Three foreign workers died while two others suffered serious injuries and were sent to
02:11 Penang Hospital for treatment.
02:13 Four others who were initially thought to be buried in the rubble were found safe after
02:18 they fled the site during the incident.
