The Malaysian Bar is merely being a "busybody" by seeking leave to commence a judicial review challenging Datuk Seri Dr Ahmad Zahid Hamidi's discharge not amounting to an acquittal (DNAA) in the Yayasan Akalbudi case, the Kuala Lumpur High Court was told.

Ahmad Zahid said this in his affidavit-in-reply to an application filed by the Bar on Dec 2 which sought to quash the Attorney General's decision that resulted in the DNAA.

00:18 The Deputy Prime Minister, in his affidavit responding to the Bar's December 2nd application
00:23 aiming to overturn the Attorney-General's DNAA decision, argued that only those directly
00:29 affected by the AG's decision could seek a judicial review.
00:33 He added that the applicant is neither a complainant nor a victim in the criminal charges brought
00:38 against him in the criminal high court.
00:41 Therefore, Ahmad Zahid said, the applicant has not met the basic criteria under Order
00:46 53, Rule 2, Subsection 4 of the Rules of Court 2012 and other legal requirements needed
00:52 to file this application.
00:54 Senior Federal Counsel Ahmad Hanil Hanbali, on behalf of the AG, argued that the Criminal
01:00 Procedure Code allows the AG to seek a DNAA at any stage before the final court verdict.
01:07 He noted that the Bar's application did not meet legal standards to challenge the AG's
01:12 decision.
01:13 Meanwhile, the Malaysian Bar President Karen Chia Yee Lin said the Bar intends to file
01:17 an application to refer certain constitutional questions to the federal court.
01:22 The matter has been adjourned.
01:24 We are putting in an application under Section 84 to have the matter referred to the federal
01:30 court on issues of law pertaining to a case, the Sundararajah case.
