Panayam kay Anit-Red Tape Authority Director General Sec. Ernesto Perez tungkol sa eBOSS (Ease of Doing Business Law)
Transcript
00:00 Update to E-Boss and Ease of Doing Business.
00:03 We will talk with Secretary Ernesto Perez,
00:08 Director General of Anti-Red Tape Authority or ARTA.
00:12 Secretary, good afternoon.
00:15 Good afternoon to all of us, especially to those watching this program.
00:20 Okay, Secretary, let's start.
00:23 Can you share with us some of the actions of the Anti-Red Tape Authority or ARTA in the past four months?
00:32 We are conducting commendations to LGUs that have become compliant with the Electronic Business One-Stop Shop,
00:42 where we last gave our commendation to the City of Legazpi last week.
00:49 It was the 25th LGU that became compliant with E-Boss.
00:55 And for the next month and so, up to May, we will continue to commend to the Siam LGUs.
01:02 And we will continue to help the DICT and DILG.
01:09 We will continue to help, of course, under the guidance of the Office of the President,
01:13 Presidential Management Staff, to have a nationwide rollout to implement the requirement of the Ease of Doing Business Law.
01:24 Because here, LGUs are required, regardless of class, whether first or sixth class municipality,
01:32 to set up and operationalize an Electronic Business One-Stop Shop.
01:37 Okay.
01:37 Maybe, Sek, to make it clearer for our countrymen, because I think they are already familiar with the physical boss.
01:44 This is the one-stop shop.
01:46 Because when you go to the municipality, instead of going to the Bureau of Fire,
01:49 you are already there.
01:51 All of them.
01:52 In the barangay, you are already there because in one.
01:55 Even the barangay.
01:56 Yes.
01:57 Because it is already in one place.
01:59 It's required by law that the barangay is already included.
02:02 So, how is this electronic boss?
02:06 As early as 2021, we had a joint memorandum circular with DICT, DILG, DTI, and ARTA,
02:15 where we laid out the implementing guidelines for LGUs to follow.
02:21 For them to become a Bible, they should follow this so that they can comply with the requirement
02:27 where the application, submitting the application, and the document, as well as the payment of license fees,
02:37 and printing of permits can be done online around the comfort of their homes and offices.
02:45 In fact, the last thing we mentioned before the city of Legazpi,
02:56 this is a 6-class municipality in Camiguin, Gensiliban Municipality.
03:03 I've been there.
03:04 It's nice there in Camiguin.
03:07 It's a 6-class municipality where they used the system that DICT made,
03:15 and they proved that even if you are a 5th or 6th class municipality,
03:21 they can comply with this requirement.
03:24 In fact, there are two testimonies.
03:27 A businessman from Zamboanga applied for a business permit in Gensiliban.
03:34 Online.
03:35 Online.
03:36 And there's another one, an OFW from Qatar.
03:40 He was given a business permit from Qatar.
03:43 So, this program is really great.
03:45 So, Sek, I can imagine, you go to the e-BOS portal of the LGU,
03:50 and then you upload your documents, and then the assessment can be done electronically.
03:54 But I'm just wondering about the payment.
03:56 Because I know that there's an official receipt that needs to be issued,
04:00 and how will you send the money?
04:02 Will you dedicate the payment to the LGU?
04:04 And the permit, because if the permit is emailed to you,
04:07 will the person who printed the permit receive it?
04:11 Yes, because the digital payment is allowed either by Land Bank, G-Cast, or Paymaya,
04:18 so you can pay online.
04:20 Yes, I did that.
04:21 Paymaya.
04:22 It's also a requirement in JNC, with DICT and DILG,
04:29 that the recognition of the printed business permit has the same value as the permit issued by the LGU.
04:39 Okay, so when you print it at home, you can just have it scaled?
04:42 Yes.
04:43 That permit?
04:44 Because there's a corresponding QR code.
04:45 Oh, I see.
04:46 So it's easy to verify if it's legitimate or not.
04:49 I see.
04:50 Did you pay for it, partner?
04:51 Yes, because there's...
04:54 That's why I'm happy because everything is electronic now.
04:58 You just have to register it.
05:04 So I don't have to go to, let's say, the Quezon City Hall, for example, to do this.
05:10 So even in BIR, for example, I pay tax,
05:13 I can also do it through Paymaya.
05:16 My accountant said, "Pay to Paymaya."
05:18 I said, "Oh, like that? Game."
05:20 It's really convenient now.
05:22 So if a 6th class municipality, you said, "I can do it,"
05:26 I'm sure the others should be able to do it soon, right?
05:30 While we're on this topic,
05:33 about the new Philippines Town Hall meetings,
05:38 can you share with us what and for what will be the new Town Hall meetings?
05:46 This is also very good.
05:48 According to the directive of our President, Ferdinand R. Marcos Jr.,
05:53 the government agencies will conduct the new Philippines Town Hall meeting.
05:59 We started this in Tacloban on March 14, 2024.
06:03 It was the first LGU where ARTA held a Town Hall meeting,
06:08 especially with the barangay officials and agencies.
06:15 There was a change.
06:17 This is not only about orienting them about the ease of doing business,
06:22 but we should also listen to their concerns,
06:25 their concerns and recommendations.
06:28 And then we conducted a Town Hall meeting in the city of San Fernando on March 18.
06:34 Pampanga.
06:35 Pampanga.
06:36 Alright.
06:36 It was very good because there was a barangay chairman,
06:40 Barangay Chairman Heason,
06:42 where he said that there should be no more political,
06:45 there should be no more fighting
06:47 for the new Philippines to have an understanding.
06:51 Let's put aside politics for the people.
06:55 And can you imagine, in San Fernando,
06:58 they are not the Mayor, Vice Mayor, and the Councilors.
07:01 They are not a political party.
07:04 But because of DILG, this is a very good role of DILG,
07:07 they united, they joined together in one stage,
07:11 the Mayor, Vice Mayor, and the Councilors and the Barangay Chairmen.
07:17 So DILG is your partner here?
07:18 Yes, of course.
07:19 DICP and DILG.
07:22 It's very good that this Town Hall meeting will be regular.
07:27 Where will the next meetings be held?
07:30 Will it be nationwide?
07:32 This was the last one on April 12.
07:34 We did this in Ligaspi, Bicol.
07:37 There were also Mayor, Vice Mayor, and Barangay Chairmen.
07:41 60 out of 70 Barangay Chairmen were there.
07:44 And we're not just talking about the benefits or the advantages
07:51 of implementing the E-BOS or the Ease of Doing Business Law.
07:55 They themselves said their concerns and recommendations.
08:00 Then we will also have April 23 in the City of Baguio,
08:05 in the Cordillera Region, Davao City, May 13,
08:10 General Santos, May 15,
08:13 in El Salvador City, May 21.
08:17 And we will do this nationwide because we saw the good effect.
08:22 We're not just letting them know about our programs and initiatives
08:28 that are good for our development.
08:31 We hear their concerns directly.
08:36 And we're having an agreement.
08:37 There's an agreement that politics should be put aside for the new Philippines.
08:43 Is there a chance for the President to join the town hall meetings?
08:50 That would be great.
08:51 Especially since we have a big town hall meeting in Mindanao.
08:56 Business leaders from the Philippine Chamber of Commerce and Industry are also here.
09:01 So hopefully, it would be great if we can all be here.
09:04 I know how difficult it is to implement this.
09:09 I was in the DILG and I was able to join Arta's Deputy Director General at that time
09:17 to encourage different LGUs to implement the E-Bus Law
09:22 together with NABLO, our partner organization.
09:25 So, sir, in terms of percentage, how many have complied in terms of implementing this E-Bus Law?
09:36 The requirements are heavy, the four requirements, the end-to-end process.
09:39 So even though they reported to the DILG that they are fully automated,
09:44 Arta is validating it in accordance with the JMC that we signed.
09:50 And so far, we've only validated 25.
09:55 And for this month and the next month, there are some schams scheduled for commendation.
10:02 We really need to validate and know that they have complied with the four functionalities that I mentioned earlier.
10:09 So we have commendation, sir, for those who have complied.
10:12 But what about those who have not complied yet?
10:15 Is there a penalty from Arta?
10:18 You know this, Usec, that when LGUs find out that this LGU has complied,
10:26 they will be encouraged, just like when we did commendation for Hasaan.
10:32 Tagaluhan followed, so they are scheduled for commendation.
10:36 It's the same with Cavite.
10:38 When we gave commendation for Carmona,
10:41 we said, "We will follow this."
10:45 Then for Laguna, Binan, and Calamba, we will follow this as well.
10:50 So if their reason is that the internet is weak,
10:57 their resources are not sufficient,
10:59 our answer to that is the municipality of Ginziliban.
11:04 Oh, right.
11:04 We will follow it.
11:05 We will follow it.
11:07 It's like, if there is really a political will,
11:10 Yes.
11:11 it will be tolerated.
11:12 There is no reason to do it.
11:14 Let's do it first.
11:16 We have a question from Patricia Lopez of IBC 13.
11:20 Since today is the last day of filing the 2023 annual income tax return,
11:26 that's why I went to BIR,
11:29 how did EBOS help in tax collection in the country?
11:34 Directly, nothing.
11:35 Because EBOS helps businessmen to register their business permit or license faster.
11:44 The effect of EBOS is that not only will more people register their business,
11:50 but there will be an additional revenue collection.
11:55 Yes.
11:56 In this way, it will help BIR because their revenue collection will increase.
12:00 And using the digital platform,
12:02 their income tax can be paid online,
12:07 just like the payment of their businessmen's permit fees online.
12:12 So, it's a great thing to have.
12:15 We encourage people not only to register their business,
12:18 but also to pay the right amount of revenues for the LGU.
12:22 Because, Sek, if it's easier to register in the LGU,
12:26 they are also required to register in BIR.
12:28 Yes.
12:29 Yes.
12:30 Correct.
12:31 So, the BIR collection increases,
12:33 the collection of local government also increases.
12:36 And I hope it will go to the right place.
12:38 Yes, of course.
12:38 So that what we are paying is worth it.
12:40 Yes.
12:42 Yes, Sek, so please send a message to our fellow countrymen.
12:46 To our fellow countrymen,
12:48 let's continue to trust our government,
12:51 especially our President,
12:53 that the Directiva will make all agencies that go to LGUs,
12:59 to barangays,
13:01 and have a new Philippines Town Hall Meeting.
13:05 We also encourage LGUs to comply with the requirements
13:11 of the Electronic Business One-Stop Shop.
13:13 And this will greatly help our economy.
13:16 So, thank you again for this opportunity,
13:19 for the art that we can share what we are doing,
13:22 and I hope that we will continue to serve
13:27 for a new Philippines.
13:30 Alright.
13:31 Thank you very much for your time.
13:32 I also have an appeal to our fellow countrymen.
13:35 If you have complaints or concerns
13:38 about red tape and corruption,
13:39 because as our President said,
13:41 to replace red tape with red carpet,
13:44 you can call the ARTA hotline,
13:46 1-2782,
13:48 or 8888,
13:49 or you can email complaints@arta.gov.th.
13:53 Okay, so Sek, this 8888,
13:56 is this already with you?
13:56 No, we have a Memorandum of Agreement
13:59 with the Citizens Complaint Center
14:01 in the Office of the President.
14:02 Okay.
14:02 Where if the complaint is ARTA-related or red tape-related,
14:07 they will report it to ARTA,
14:09 and ARTA will investigate
14:11 if the agency does not comply with the requirement
14:16 that they respond to the concern or complaint
14:20 that was filed by the Complaint Center
14:23 to the government agency.
14:24 Alright.
14:25 Thank you very much for your time.
14:27 Secretary Ernesto Perez,
14:28 the Director General of the Anti-Red Tape Authority.
