00:00 Comelec said they are ready to face a case that will be filed against them by Smartmatic.
00:05 The Supreme Court's decision was released after they disqualified the company from bidding.

00:15 Even though Smartmatic is no longer included in the bidding for the 2025 national and local elections,
00:23 the company will be able to join the country's electoral procedures.
00:27 The Supreme Court decided that Comelec was wrong to suspend and disqualify Smartmatic.
00:35 The SC said that Comelec violated their own process.
00:40 It held that Comelec committed grave abuse of discretion when it disqualified Smartmatic
00:45 before it had submitted any bids without any reference to the eligibility requirements prescribed by its Bids and Awards Committee.
00:53 The court also explained that before Comelec suspended, Smartmatic should have submitted its bid first.
00:59 That's why it's clear that Comelec was wrong to suspend the company that submitted its bid.
01:05 As of now, Smartmatic can indeed participate in the next elections,
01:11 but it's subject to, let's say, if anyone files a disqualification case against them again.
01:16 Even though the Supreme Court's decision is clear that Smartmatic is the one to be disqualified,
01:21 it is still not a complete favor to the company,
01:25 especially since it will not have any effect on Comelec's signing of the Mirror Systems Company Ltd.
01:30 to become the new fast-track system provider of the Philippines in the 2025 national and local elections.
01:37 The Supreme Court did not grant the TRO or writ of preliminary injunction.
01:41 It held that Smartmatic did not have an actual clear and positive right for a TRO or writ of preliminary injunction
01:50 because Smartmatic was merely a prospective bidder.
01:53 The Supreme Court did not find it sufficient to nullify the public bidding or award of the contract.
01:59 For Smartmatic, the court's decision is enough to say that there was a due process.
02:05 It is ready to reunite with them in the next elections in the country.
02:10 Meanwhile, Comelec said that they accepted the court's decision.
