Richard Marles addresses legislation on detainees

Almost five months after rushing new laws through the parliament, Deputy Prime Minister Richard Marles has indicated the government is making progress on getting some former immigration detainees locked-up again.

00:32 So we are working on this as expeditiously as we can on the basis of a model which was
00:38 suggested by the Coalition which they themselves operated and operated much more slowly than
00:44 what is going on right now.

00:52 It is arguable, and I'm not sure it has been argued in the Court, but it's arguable that
00:57 on the timeline of events there in Perth, if a PDO had been applied to Dukhshan, he
01:04 may not have been in a position to commit the crime that he's alleged to have committed
01:08 here.
01:09 Well, I mean that's total conjecture.
01:15 The process by which one puts in place orders of this kind is very significant.
01:21 You are talking about putting somebody into custody not based on what they've done but
01:26 on what they might do.
01:27 So unsurprisingly there is a very high standard which needs to be met here in terms of submissions
01:33 that are made.
01:34 When you look at what the Coalition did, when they had this in place, the period of time
01:40 that it took to even make an application was far longer than what we're talking about between
01:44 when this legislation passed the Parliament and today.
