00:00 An international court governing the world's oceans is calling on countries to protect

00:07 marine environments by reducing their greenhouse gases.

00:11 A move that some legal analysts say could impact the future pledges countries make under

00:17 the Paris Agreement.

00:19 Ross Cullen reports.

00:21 The oceans and coastlines are some of the world's most beautiful places, but also some

00:26 of the most fragile.

00:28 And now a top court says that carbon emissions can be considered a sea pollutant.

00:33 The International Tribunal for the Law of the Sea is the UN's court for marine and maritime

00:39 disputes.

00:40 Its latest ruling is that the emissions from GHGs, or greenhouse gases, that are absorbed

00:46 by the seas are considered marine pollution.

00:49 The convention and the Paris Agreement are separate agreements with separate sets of

00:54 obligations.

00:55 Article 194, paragraph 1, imposes on states a legal obligation to take all necessary measures

01:03 to prevent, reduce and control pollution from anthropogenic GHG emissions, including measures

01:09 to reduce such emissions.

01:12 The court also called on the world's most powerful countries to carry more of the burden

01:17 because small island nations are being disproportionately affected by climate change.

01:23 In the context of marine pollution from anthropogenic GHG emissions, states with greater means and

01:29 capabilities must do more to reduce such emissions than states with less means and capabilities.

01:38 The court's opinion is only advisory and non-binding, but the ruling could make waves in future

01:43 climate cases because experts say it could have far-reaching implications for countries'

01:49 climate change obligations.
