At least 106 containers filled with electronic waste (e-waste) have been found in Malaysia’s ports over the past three months with close to another 200 containers also suspected to contain the same, says Nik Nazmi Nik Ahmad.
The Natural Resources and Environmental Sustainability Minister said that the Customs Department had seized 301 containers suspected of containing e-waste from March 21 to June 19.

00:00On this day, the Ministry of Natural Resources and Environment, through the Ministry of Environment and Environmental Affairs,
00:12we went down to revoke the illegal use of electronic waste, or as we call it, e-waste.
00:19And based on the information received by the Malaysian King's Customs Department, JKDM,
00:27from 21st March 2024 until 19th June, 301 containers that are suspected to contain e-waste have arrived in Malaysia.
00:38And the inspection results found 106 containers containing e-waste and the rest were metal scraps.
00:46So, a joint inspection and detention was carried out by the relevant agencies.
00:53For the e-waste containers, the case is still under investigation by the Ministry of Environment and Environmental Affairs
00:59under Section 34B of the 1974 Act on Environmental Quality.
01:05This section condemns the violation of any scheduled disposal of waste,
01:12whether on land or in the waters of Malaysia,
01:16transit or permitting e-waste transit without the approval of the Ministry of Environment and Environmental Affairs,
01:22and if proven, the violation can be sentenced to no more than five years in prison
01:28and a fine of no more than RM500,000 or both.
01:33At the same time, we have just finished the Parliamentary process for the transfer of punishment,
01:42which means that if this happens, the punishment will be higher,
01:46the fine will be higher and the imprisonment will be more serious.
01:51For the remaining containers, they are suspected to contain metal scraps and are still under Customs Act,
01:56which is found to be under Section 135 of Section 1A of the Customs Act of 1967,
02:03which prohibits the importation of goods under Section 5 of the 4th Customs Regulations,
02:08prohibiting the importation of goods under Sections 20 and 23.
02:11Any metal scrap import must be carried out in accordance with the procedure outlined by the Ministry of Environment and Environmental Affairs,
02:16whereby the importer must obtain a Certificate of Approval from the Ministry of Environment and Environmental Affairs.
02:23The Ministry of Environment and Environmental Affairs will continue to enforce monitoring and enforcement
02:29for the importation of e-waste used by our industry again.
02:33Strict action will be taken against any importers who fail to comply with the rules and laws that have been established,
02:41including sending the e-waste container back to the country of origin,
02:45because we are among the signatories of the Basel Convention, which is held internationally.
02:52We still haven't received any e-waste containers that have been illegally operated around Lembah Klang,
02:56which means they have not been registered with the Ministry of Environment and Environmental Affairs,
02:58and most of them have been received through illegal metal operations.

03:03Yes, we are aware of this matter and that is why we will bring this matter.
03:07I think because we know that we have received a lot of complaints from the community,
03:12and I think when we bring it to the Cabinet, we will be able to see how we can deal with this issue together.
