00:00Asalam-o-Alaikum, dear viewers, welcome to the program.
00:10The biggest news of the world right now is that the Tulba movement that is going on in Bangladesh,
00:19as a result of its demand, a non-representative, a coalition parliament of Bangladesh has been dissolved.
00:29What will be the next step? We will talk about this story in detail in the second part of our program.
00:35But first of all, the issue in Pakistan right now, the issue that is in front of us,
00:41which is a challenge to the people of Pakistan, to the parliament of Pakistan,
00:45is that a new law has been presented in the parliament, which has been passed by the National Assembly.
00:51And the purpose for which the law was made is very clear.
00:57The majority judgment of the Supreme Court has to be considered null and void or it has to be proven ineffective.
01:05Today, when this law was presented, Mr. Bilal Azhar Qaini, who is the MNA of JLM,
01:13his opponents say that he is also from Farm 47.
01:16Anyways, he is explaining the three basic points of the law.
01:21Our amendments to the Elections Act have been passed by the National Assembly today.
01:26There are three parts of the bill.
01:27If you do not submit your party certificate in front of the returning officer as a candidate,
01:32then you will be considered a free candidate.
01:34If any party does not submit its list of reserve seats at the appointed time,
01:38then that party cannot be eligible for the quota of reserve seats after the elections.
01:42When a free candidate contests the election and wins,
01:46then if he decides to join a party, then that decision is irrevocable.
01:52It cannot be reversed.
01:54Viewers, if you look at the draft of the law that has been passed by the National Assembly today,
01:59there are three or four parts that have been included in it.
02:01The current government says that we have only authorized the laws of the past.
02:05The important point that has been put in it is that this law,
02:10show it to the producer,
02:12that it will be in effect from 2017.
02:16The law has been passed today, but it will be in effect retrospectively from 2017.
02:22After that, another point has been put down that if there is an order from the Supreme Court,
02:28if there is an order from a high court,
02:30then there will be no obstacle in the practice of this law.
02:35This has basically been targeted by the Supreme Court's decision.
02:39We are not saying this.
02:40Barrister Gohar in the Parliament is saying this. Listen to this.
02:47Thirteen judges sat in front of the Supreme Court.
02:51Eleven judges gave their opinions.
02:53They unanimously voted that Pakistan Tehrik-e-Insaf is a political party.
02:59The Supreme Court also voted that we are entitled to all those seats.
03:04This Parliament is definitely supreme,
03:06but interpreting the constitution is the right of the Supreme Court.
03:11If the Supreme Court interprets the law,
03:14that is the final word.
03:15This Parliament cannot set aside that interpretation.
03:18By creating a new law,
03:20illegal unconstitutional,
03:22which we announce on the floor,
03:24God willing, we will challenge this,
03:26and God willing, the Supreme Court will set aside this challenge.
03:30Viewers, we have invited Kamal Dilshah to our program.
03:33He is the former Secretary of the Election Commission.
03:35He has a lot of knowledge about the laws in Pakistan,
03:39especially regarding the current elections.
03:42We read a lot of his comments in the newspapers.
03:47Thank you very much, Kamal Dilshah.
03:49Please explain in general terms.
03:52A Supreme Court decision has come,
03:54Pakistan's largest court.
03:56The decision is also unambiguous.
03:58It is a majority decision,
04:00according to Article 8.5.
04:02As Mr. Gore said,
04:0411 judges, including the Chief Justice of Pakistan,
04:08agreed that the Election Commission
04:11had misinterpreted our decision.
04:14The candidates of Pakistan Tariq-e-Insaaf were present.
04:17When the election of Pakistan Tariq-e-Insaaf took place,
04:20it should have been present as a parliamentary party.
04:23Due to the wrong decision of the Election Commission,
04:26a big mistake was made.
04:30A grave sin was committed.
04:32All the judgments were made to rectify that sin.
04:36Now, the Parliament has come forward.
04:39The Parliament has passed the law.
04:41The National Assembly will now go to the Senate.
04:43Obviously, there will be an investigation.
04:47So, what next?
04:50What do you expect from the people of Pakistan
04:53or the media of Pakistan?
04:55On one hand, the Supreme Court's judgment.
04:57On the other hand, the National Assembly's new law has been passed.
05:01What will you say about this?
05:03You have run the Election Commission for many years.
05:06You have seen the election laws very closely.
05:08Yes, Mr. Qamar.
05:10The most important thing in this is that
05:13the majority of the Supreme Court of Pakistan
05:17has not passed a formal ruling,
05:20but has decided
05:22that the Election Commission of Pakistan
05:24should make its own ruling on specific seats.
05:28But along with this, there is a very important thing
05:31that the media has ignored.
05:33The biggest thing in this is that the Election Commission of Pakistan
05:36has presented a new point in the Supreme Court of Pakistan
05:40that according to our Election Act 208,
05:44the Justice Movement did not hold the right elections.
05:49So, according to our record,
05:51they do not have a party structure.
05:53They do not have a secretary-general or a chairman.
05:56So, they should present reasons for this.
05:59In this case, when the nomination papers are presented,
06:02who will sign them?
06:04Neither the secretary-general nor the chairman can do it
06:08because in the eyes of the law,
06:10he is neither a chairman nor a secretary-general.
06:12So, this is a loss that the Election Commission
06:14has deposited in the Supreme Court of Pakistan.
06:17So, they will enforce it.
06:19But today, the Election Act has been approved
06:21on the third day.
06:23Now, the Parliament will have a majority.
06:27And the Supreme Court of Pakistan
06:29will not take any action
06:31according to the circumstances.
06:33Just like during the time of Umar Atta Bandiyar,
06:35they had issued an election statute
06:37for Punjab and Khyber Pakhtunkhwa,
06:39but they did not approve it by the Parliament
06:41and made it null and void.
06:43At that time, Umar Atta Bandiyar's justices
06:45were present.
06:47So, looking at these circumstances,
06:49we can see that the case of women's
06:51specific consultations has become political.
06:53It has been out of the hands of the law.
06:55A serious problem has arisen.
06:57So, in the same way, the Election Commission
06:59will continue to pursue this case
07:01in the Supreme Court.
07:03And it will not come to an end.
07:05But the Parliament has passed a bill.
07:07In my opinion, the Supreme Court of Pakistan
07:09can sign a petition.
07:11But looking at the current Chief Justice,
07:13we can see that he will
07:15refrain from intervening in this case.
07:17He has already decided that
07:19the Parliament is very strict.
07:21We will accept the decision of the Parliament.
07:23So, the decision of the Election Commission
07:25of Pakistan,
07:27which is called the Election Act 104,
07:29will remain in force.
07:31And the Election Commission
07:33has made its ruling
07:35that we have to look at the Supreme Court
07:37and the High Courts,
07:39but we also have to look at the Election Act.
07:41And today they have got a lot of strength
07:43that the Election Act has been approved.
07:45So, in your opinion,
07:47this case is being presented
07:49again in front of the Supreme Court
07:51of Pakistan.
07:53Obviously, you are absolutely right.
07:55When a new law has been made
07:57and it has also been pointed out
07:59that no decision of the Supreme Court
08:01will affect it,
08:03no decision of the High Court will affect it.
08:05So, a decision is already in the field.
08:07So, when that decision has to be taken back,
08:09at some point,
08:11will it go to the government?
08:13After the approval of the Election Act,
08:15the decision of the Supreme Court
08:17has already been made.
08:19So, the Parliament
08:21and the Supreme Court
08:23will not come together.
08:25So, they will have to approve
08:27the decision of the Parliament,
08:29but they will raise it.
08:31Absolutely right.
08:33Now, Mr. Kamal Dilshah,
08:35those 77 seats,
08:37how will the solution
08:39of those 77 seats come out?
08:41Because the real fight is on that.
08:43Now, it has been said that
08:45this cannot happen.
08:47Now, the decision of the
08:49Peshawar High Court,
08:51the election commission,
08:53the decision of the Supreme Court
08:55has already been made.
08:57After this, what will happen next?
08:59What will be the solution of this issue?
09:01Mr. Kamal Dilshah,
09:03you are also right.
09:05These seats will not be given
09:07to any party and this system
09:09will continue to run like this.
09:11I have seen that
09:13Sunni Daal is not taking much interest
09:15and PTI is also playing a political game.
09:17And PTI is not even able to see
09:19that the foreign funding case
09:21which has been forced by the
09:23election commission of Pakistan,
09:25has to be decided.
09:27And if the foreign funding case
09:29has been forced,
09:31then where will the party stand?
09:33Mr. Kamal Dilshah,
09:35our issues are very serious.
09:37It is very important.
09:39You have to accept it today.
09:41Mr. Kamal Dilshah,
09:43thank you very much.
09:45Mr. Chaudhary,
09:47I will come to you.
09:49Mr. Kamal Dilshah,
09:51a law has been passed
09:53by the parliament.
09:55A fight has already started.
09:57On one side is the parliament
09:59and on the other is the Supreme Court of Pakistan.
10:01The Supreme Court has said
10:03that after the change in the Election Act,
10:05the Supreme Court's decision
10:07will not be affected.
10:09Mr. Chaudhary,
10:11the question that arises here
10:13is that the fight will continue.
10:15It is a matter of 77 seats.
10:17Where will they go?
10:19Because you cannot keep
10:21the parliament incomplete.
10:23Article 53 of the BIN
10:25says it very clearly.
10:27So what will happen?
10:29Mr. Chaudhary,
10:31I am asking you.
10:33There will be new elections in the country.
10:35Mr. Chaudhary,
10:37what is your opinion?
10:39If we answer in one sentence,
10:41it is that
10:43these seats are not
10:45of the ruling party.
10:47But when the disease increases,
10:49the diagnosis of the disease
10:51is done from the very beginning.
10:53How did this disease start?
10:55You were told to hold
10:57elections of the ruling party.
10:59You did not do it.
11:01You did it.
11:03It was a doubtful election
11:05which the Election Commission
11:07refused to accept.
11:09Now you have come to the Assembly
11:11and you had an open option.
11:13You even announced
11:15that you are going with
11:17Majlis-e-Wahidat-e-Muslimeen.
11:19While going with Majlis-e-Wahidat-e-Muslimeen,
11:21you took a turn
11:23and went with a group
11:25and the Supreme Court gave a decision.
11:27Of course, the Supreme Court has a right.
11:29But those against whom a decision is given,
11:31they also have a right to go for a review
11:33and appeal.
11:35They filed a review.
11:37The Supreme Court said that
11:39we are going on leave.
11:41We will see what to do after the leave.
11:43Now that they have gone on leave for two months,
11:45it is obvious that the Parliament
11:47is finding its way.
11:49The Parliament has found its way
11:51and has come to this point
11:53where you can sit in the drawing room
11:55and ask questions,
11:57but you cannot legally challenge it.
11:59Hassan,
12:01it is obvious that there is a fight.
12:03Many people are saying
12:05not less than Khawaja Asif
12:07and the government.
12:09Khawaja Asif, first tell me one thing.
12:11Yes, sir.
12:13The law that has been
12:15enacted today by the
12:17Mufat-e-Prashti,
12:19can it overrule
12:21the Constitution?
12:23I will come to you.
12:25Some people think that
12:27we are heading towards Khawaja Asif.
12:29You spoke about the Constitution meltdown.
12:31Yes, the Constitution meltdown.
12:33It is obvious that a situation has developed.
12:35I agree with your opinion.
12:37After this act of the Parliament,
12:39the decision of the Supreme Court
12:41is part of the dustbin.
12:43No, no, no.
12:45I am saying that
12:47this is not my opinion.
12:49My opinion is that
12:51when the ECP has not
12:53misinterpreted the decision
12:55of the Supreme Court on 13th January,
12:57the decision that the Supreme Court
12:59has given is not right.
13:01I have never said that...
13:03What is the method for its interpretation?
13:05The method they used
13:07was that
13:09the decision was
13:11that the elections
13:13should not be held
13:15under section 208.
13:17The party could not
13:19get a uniform symbol.
13:21We should not waste time.
13:2311 judges including
13:25the Chief Justice of Pakistan
13:27are saying that
13:29the ECP has misinterpreted
13:31the decision.
13:3311 judges of the Supreme Court
13:35are saying this.
13:37What is the solution?
13:39They made one more mistake.
13:41What is the solution?
13:43I will tell you one more mistake.
13:45The Law of the Judges and Procedure Act
13:47says that
13:49when a review file is filed,
13:51you have to fix it within 14 days.
13:53You are not fixing it within 14 days.
13:55What is the solution?
13:57The solution is
13:59that the way Mr. Nawaz
14:01was punished
14:03on behalf of the NAB
14:05was also retrospective.
14:07This was not the case of that time.
14:09He was divorced and was punished.
14:11In the same way,
14:13the law of the judges
14:15has been made retrospective.
14:17Now the solution is
14:19that the Supreme Court
14:21has to bow down
14:23in front of the Parliament.
14:25There is no other option.
14:27They have to review
14:29their own decision.
14:31Otherwise,
14:33they have no other option.
14:35The Parliament cannot
14:37call the Supreme Court
14:39in contempt.
14:41The Supreme Court of Pakistan
14:43must have changed the
14:45constitutional amendment as well.
14:47You are present in this case.
14:49What will happen in this case?
14:51You will get the opinion of
14:53Mr. Hassan and the rest of the people.
14:55Mr. Chaudhary is asking
14:57if everything is going according
14:59to the constitution and the law.
15:01Our research team has found
15:03some facts.
15:05First of all,
15:07Azan Nazir Tariq
15:09stood under the name of Allah
15:11and made a claim.
15:31This is his claim.
15:33The opposition is rejecting it.
15:35There is an important point
15:37that Sunit Haad Council
15:39was asking for seats.
15:41Sunit Haad Council
15:43was asking for seats.
15:45They never asked for the seats of
15:47Pakistan Tariq-e-Insaf.
15:49Did Pakistan Tariq-e-Insaf
15:51refuse to take the seats?
15:53What did Azan Nazir Tariq
15:55say?
16:07Azan Nazir Tariq
16:09was asked
16:11if he was asking for the seats
16:13of Pakistan Tariq-e-Insaf
16:15or Sunit Haad Council.
16:17Faisal Siddiqui said
16:19he was asking for the seats
16:21of Sunit Haad Council.
16:23Kamal Shozab's lawyer
16:25Raja Salman Akram
16:27was asked
16:29if he was claiming the seats
16:31of Pakistan Tariq-e-Insaf
16:33or Sunit Haad Council.
16:35We are not saying anything wrong.
16:37Azan Nazir Tariq
16:39was asked
16:41if Sunit Haad Council
16:43was not a
16:45parliamentary party.
16:47How can you ask for the seats
16:49of Sunit Haad Council?
16:51Sunit Haad Council
16:53was not a
16:55political party
16:57because it has
16:59neither participated
17:01in the election
17:03nor has won any seat.
17:05Therefore,
17:07this debate has become
17:09secondary.
17:11Since it is not a political party,
17:13independent candidates
17:15cannot join it.
17:17Even if they join it,
17:19it has no place
17:21in the law.
17:23This question
17:25was asked by
17:27Justice Mansoor Ali Shah
17:29to Faisal Siddiqui.
17:31He was asked
17:33if Sunit Haad Council
17:35is not a political party,
17:37then where will the
17:39seats of Sunit Haad Council
17:41go?
18:01They will go
18:03and the Lordship will explain
18:05who the independents are
18:07and where they came from.
18:09After that, Justice Mansoor Ali Shah
18:11has a dialogue with Faisal Siddiqui.
18:13He also asks him
18:15the same question
18:17in the same background
18:19that the independents
18:21will not go to Sunit Haad Council
18:23but will go to Tariq-e-Insaf
18:25if it becomes a parliamentary party.
18:27Assalam-o-Alaikum.
18:29Sir, I don't think
18:31the Sunit Haad Council
18:33will have any problems.
18:59Assalam-o-Alaikum.
19:01Assalam-o-Alaikum.
19:03Assalam-o-Alaikum.
19:05Assalam-o-Alaikum.

19:19Assalam-o-Alaikum.
19:21Assalam-o-Alaikum.
19:23Assalam-o-Alaikum.
19:25Assalam-o-Alaikum.
19:27We have joined Sunit Haad
19:29in accordance with the law.
19:31We were declared independent.
19:33For that we can't be faulted.
19:35Assalam-o-Alaikum.
19:37Assalam-o-Alaikum.
19:39Assalam-o-Alaikum.
19:41Assalam-o-Alaikum.

25:31The circumstances and events that took place in Bangladesh
25:33the same thing happened there
25:35the opinion of the people
25:37was not being heard.
25:39People were repeatedly calling
25:41for our rights.
25:43When it was not heard
25:45the circumstances and events are before you.
25:47We will talk in detail after the break.
25:53Viewers, according to the Pakistan's constitution
25:55the definition of a state
25:57is before you.
25:59The definition of a state
26:01is the same
26:03in all the parliamentary systems
26:05and governments of the country.
26:07What is the definition of our state?
26:09You hear about a state
26:11like a mother.
26:13What is a state?
26:15Article 7 of the Pakistan constitution
26:17says that a state
26:19is defined by the government of the day
26:21which is the present government
26:23and that government is formed
26:25from the stomach of the parliament
26:27which includes the National Assembly
26:29the Provincial Assembly
26:31and the local governments.
26:33The elected representatives
26:35play a key role
26:37in the state.
26:39They use the power of the state.
26:41Therefore,
26:43the elected representatives
26:45must be chosen
26:47through a transparent election.
26:49What happened in Bangladesh?
26:51When the elections were held
26:53at the beginning of this year
26:55internationally
26:57and all over the world
26:59the observations of the elections
27:01were as follows.
27:03Bangladesh democracy is strained
27:05as Haseena wins a fourth term
27:07in a boycotted low-turnout vote.
27:09The US-UK
27:11says Bangladesh elections
27:13extending Haseena's rule
27:15were not credible.
27:17The diplomat Bangladesh
27:19flawed elections increases
27:21polarization, risk of violence.
27:23This was the commentary
27:25of the BBC on the elections.
27:27Bangladesh elections
27:29lopsided polls leave disillusioned
27:31voters asking what is the point?
27:33What is the purpose of all this exercise?
27:35Al Jazeera also
27:37raised dummy candidates
27:39on this topic.
27:41Coerced voting inside the Bangladesh elections
27:43is also mentioned there
27:45that all this is a mess
27:47which has been created.
27:49Now, what happens is
27:51this is a very big event
27:53in the history of Bangladesh.
27:55The students of Bangladesh
27:57go there and the people
27:59stand with them.
28:01There is a big story
28:03going on in the world.
28:05Yesterday, the army chief
28:07said that we are going to
28:09make an interim government.
28:11Today, the students
28:13who have started,
28:15their leaders have come out
28:17and said that we do not need
28:19the government of Dr. Yunus
28:21in the name of micro-finance.
28:23We need a government
28:25under his leadership
28:27and we need to move forward
28:29and listen to the new elections.
28:31Since the elected representatives
28:33of the people
28:35had reached there
28:37due to the elections,
28:39the people of Bangladesh did not accept them.
28:41Now, what happens after that
28:43is that in Pakistan,
28:45as I said yesterday,
28:47there is no one
28:49who is doing his best
28:51to fulfill his needs.
28:53We saw some tweets
28:55especially
28:57that Pakistan Muslim League
28:59is joining it with Bani PTI.
29:01We got an old tweet
29:03of Marjiam Nawaz Sharif
29:05who is the chief organizer
29:07and the chief minister of Punjab.
29:09She said that
29:1149 years ago,
29:13today, Pakistan
29:15lost two elections
29:17because a dictator
29:19refused to accept the mandate
29:21of the people.
29:23He rejected the recommendations
29:25of Hamudur Rehman Commission
29:27and even today,
29:29the vote is being rejected.
29:31Now, this will not happen.
29:33The nation has gone.
