00:00The Industrial Court in Kota Kinabalu, Sabah, said Malaysia Airport's Sindirian Berhad
00:07had failed to demonstrate sympathy, understanding and compassion before dismissing a former
00:12firefighter said to be medically unfit.
00:16Ruling that the dismissal was without just cause or excuse, Industrial Court Chairman
00:21Indra Ayub said Malaysia Airports also failed to sufficiently consult the claimant, Mohamad
00:26Mutok, on his medical condition.
00:29He said the company dismissed Mohamad on October 19, 2020, 17 months short of his retirement
00:35age, without setting up a medical board to obtain advice.
00:39The court held that Mohamad was not entitled to compensation in lieu of reinstatement as
00:44he had passed the retirement age of 60, but awarded him Rs 91,000 in back wages.
00:51Indra said it was trite law that employers were required to give employees sufficient
00:56time to recover, especially in this case which involved an employee who had served
01:01the company for over 38 years.
01:04Indra said the company was expected to treat the claimant well, especially given his medical
01:09issues, noting that Mohamad's strenuous daily work routine may have taken a physical
01:15toll on him.
