00:00They were put under house arrest or transferred to the custody of the AFP.
00:04That's what Pastor Apollo Quiboloy's camp is asking for.
00:07Now, he's in the custody of the PNP.
00:09Witness, Marie Zumal.
00:16On August 24, when the police entered the compound of the Kingdom of Jesus Christ or KOJC in Davao City,
00:24their mission was to arrest KOJC founder Pastor Apollo Quiboloy and other accused.
00:30And yesterday, after the search,
00:33the authorities caught Quiboloy, who was arrested earlier in Camp Krame.
00:38According to the PNP, he's the one wearing a cap with the mark of an eagle,
00:42covered from his face to his body.
00:45The faces of the accused and KOJC members,
00:49Jacqueline Roy, Ingrid Canada, Crescente Canada, and Silvia Semanes, were also covered.
00:55Before this,
00:56Do you have the right to remain silent?
00:58They were charged with Miranda Rights and were put under a booking procedure.
01:03What the PNP will get from this process has already been learned by the PNP before being distributed to the media.
01:08They will be shot.
01:11They are now in jail at the PNP Custodial Center.
01:14What the camp is asking for,
01:16the pastor surrendered and was not arrested.
01:19An arrest is only made when there is an actual restraint of the person to be arrested.
01:23In this case, there was no actual restraint.
01:25He decided to make the ultimate sacrifice of surrendering
01:30so that the sufferings of his members would end.
01:34But President Bombon Marcos and the Interior Department insisted that they were cornered,
01:39so they were forced to surrender.
01:41It won't be clear if we don't chase what we want.
01:46What happened is that he was forced to go out because the police were already close to him.
01:51The police were determined and I instructed them,
01:55this is the last time, I told them that if we go in,
01:58you will not leave until you get him.
02:01And that's exactly what they did.
02:03For me, it makes no difference if you surrender.
02:07Because that's it.
02:08Practically, you were cornered.
02:10According to the DILG Secretary,
02:12the information is currently being distributed outside the KOJC compound.
02:16Kiboloy surrendered.
02:17That's a story of a car driver.
02:19Do you know why?
02:21Because you're already out here, you ran away.
02:24He's been saying that for a long time.
02:26He won't be caught, right?
02:28The DILG wants to investigate and answer the people who were cornered by Kiboloy.
02:33The lawyer of the pastor who was involved in the possible investigation is ready.
02:38Yet yesterday, the pastor returned to the KOJC compound.
02:43He had to meet his leaders again.
02:47That is why on September 8,
02:49there was already a decision that he will surrender.
02:53And on September 8 in the morning, I was informed about it.
02:56And in front of the ISAF officers and the PNP,
03:02the decision was made prior to September 7, he will not be in the compound.
03:06He also argued that he only just found out where Kiboloy was hiding.
03:11He told me that he was in the mountains of Davao City.
03:14I was not able to verify from him.
03:18The events happened too fast.
03:21It was Friday last week when the PNP received a tip that Kiboloy was hiding inside the ACQ College of Ministry.
03:291,000 staff and SWATs surrounded the place to make sure that no one will be able to get out.
03:36Early in the afternoon, the final assault was carried out.
03:39But there were surrender feelers, which is why the arrest was postponed.
03:42At 10 p.m., we heard the feelers.
03:46The National Headquarters called because the negotiations were high-level feelers.
03:53So I said, okay sir, I will hold until 1 a.m.
03:55My first assault was at 1 a.m.
03:59We will hold until 3 p.m.
04:02A C-130 plane of the Air Force arrived in Davao and left the place where Kiboloy was hiding.
04:08They were ridden by a convoy that traveled to them to ride the C-130.
04:12The President said that Kiboloy asked for the presence of the Armed Forces of the Philippines in his assault.
04:18But the AFP and PNP were the first to intervene.
04:23I hope the AFP will be present because they said that they don't trust the police.
04:28So fine, that's what we did.
04:30But let's be very clear, this was a police-led operation.
04:35Kiboloy was charged with qualified human trafficking and child abuse and sexual abuse here in the Philippines.
04:41This is anchored in the complaint of Alias Amanda,
04:43a minor who was taken from Pasig to Davao City,
04:47where Kiboloy was temporarily taken.
04:50According to his lawyer, Alias Amanda is happy with this development
04:54and is now preparing to face Kiboloy and other accused in court.
04:59The Justice Department is investigating him being placed in the Witness Protection Program.
05:04The victims and former workers of KOJC in America
05:08were also happy with the arrest of Kiboloy and other accused.
05:11But they have a call.
05:14I hope the PNP will rescue those who are still inside Kiboloy's quarters,
05:21especially the minors.
05:23The Federal Bureau of Investigation of America also wants Kiboloy
05:27for cases of sexual trafficking of minors,
05:30fraud, conspiracy, bulk cash smuggling, and money laundering.
05:34Yesterday, the Philippines and America issued freeze orders
05:38on Kiboloy's bank accounts, properties, and other assets.
05:42The cases in America and here in the Philippines are almost the same.
05:46The accused are different kinds of witnesses.
05:48They have different lives, but one is a reclaimer.
05:51The Justice Secretary assured that Kiboloy has nothing to do with politics
05:55in the justice system of the Philippines.
05:57After this, a possible request from America will be discussed.
06:01We expect the US to file an extradition request very soon.
06:07We have a treaty with the US and it's part of the law of the land.
06:11We will have to play it out well.
06:14Well, the extradition request is not yet there.
06:19Besides, the judicial processes
06:25that Apollo Kiboloy is going to have to go through now,
06:29locally, still have to be done.
06:33Because what has been done is that we have implemented
06:37and enforced an arrest warrant that was issued by the court.
06:42For the moment, we are not looking at extradition.
06:46What we are looking at are the cases,
06:49the complaints that were filed here in the Philippines.
06:53And that is what he needs to face first.
06:55Now that the arrest order of the court of Pastor Kiboloy has been implemented,
06:59it is in the hands of the judicature that he will face next.
07:02The President assured that his rights will be protected
07:06while there is no special treatment that will be given to him.
07:09Earlier, Kiboloy was brought by his lawyer to the PNP Custodial Center.
07:13They will request the court to remove the pastor.
07:16Right now, we filed a motion for the transfer of his custody to the AFP,
07:22citing among other grounds, security reasons.
07:26And we are hoping that the court would grant the same.
07:30Or at the very least, a house arrest,
07:34knowing that he is already 74 years old, he has health conditions.
07:39But the Defense Department said that the motion to transfer Kiboloy's custody
07:43to the AFP will be followed.
07:45The AFP facilities have strict operational security protocols.
07:50That is why this is not the agency that should hold the custody
07:53of suspects in criminal cases.
