00:00Mr. Zubair, please tell us one thing, that there are proposals, but no one is aware that
00:06these are the same proposals that the government wants to bring, or they have thrown a feeler
00:10because there are 3-4 different drafts that are circulating in the market right now.
00:15Obviously, everyone has their own draft.
00:18So, why are you in such a hurry that you immediately went to the Supreme Court and
00:22filed a petition there?
00:23Yes, Mr. Zubair.
00:24Bismillah-e-Rahman-e-Rahim, thank you very much.
00:27You see, I have always fought for the law and order.
00:32As the President and Secretary of the Sindh High Court Bar, I also challenged the 21st
00:38Amendment, sir.
00:39You must remember the military courts that were made in those days.
00:43And then, as President of the Supreme Court Bar, it is right in front of you that I fought
00:48for the law and order.
00:51Now see, the issue is that the amendment that we have received, whether it is correct
00:55or not, we will find out later.
00:56Naturally, if the case is filed, then the court will ask whether the amendment that
01:01you have filed is correct or not.
01:03Show us the draft.
01:05So, it is possible that if we order them, we will find out.
01:08Because as far as I have heard, there are 57 sections.
01:11The copy that we have received, which we have challenged, in which all the judiciary
01:15has been covered, there are 43 in it.
01:18And some such articles are also being amended in it, such as Article 17, Article 48, 63A.
01:25And then what is done with the judiciary, you say, what is the hurry?
01:29Sir, this nation should be in a hurry.
01:31Because I will try my best in my life that the Constitution of Pakistan and the court
01:36of which I am a part, I have practiced all my life here in these honorable courts.
01:41And we have worked very hard for their freedom over the years.
01:44Even in the time of martial law, you have also seen martial law, these things did not
01:49happen.
01:50This is not the amendment of the court.
01:52This court is being destroyed.
01:54The Supreme Court of Pakistan has been terminated.
01:56It will be wrapped up.
01:57Which is a constitutional court.
01:59The jurisdictions of the High Court have been completely terminated.
02:01An issue has been made that the High Court has not been written on national security.
02:05An example of a High Court judge will be of a common bureaucrat, whose ACR will be written
02:10every year, on which they will check that the judge is doing the right thing.
02:13If he is not doing the right thing, then he will be sent to the Supreme Judicial Council.
02:16And who is the majority in the Supreme Judicial Council?
02:19Those of the judges of the Constitutional Court, who will be their own people.
02:23So you tell me, your freedom is coming to an end.
02:25You, the journalist, the whole nation should stand up.
02:28And then the military and their amendments that have come in front of it are also very
02:32dangerous.
02:33Okay, Mr. Zubair, tell us a little bit, especially this new court, the Federal Constitutional
02:39Court.
02:40This has been a demand, it has also been of a lawyer, it has also been in a Charter
02:44of Democracy.
02:45And Kamran Murtaza has also told us a little while ago that there is no harm in making
02:50it.
02:51But that should be under the Supreme Court of Pakistan.
02:54But what has come before us so far has been put on top.
02:57So how will it work in parallel or how will it work under it?
03:01Explain a little bit.
03:02If necessary, then what is wrong in that?
03:04Look, no.
03:05No one will object to the Federal Constitutional Court being made.
03:09But the Supreme Court, you send the proceedings of Article 184 there, absolutely.
03:14But the method of its appointment will be the same as that of Article 175a.
03:18It is not that the judges of Prime Minister and President Milkim will be made.
03:21And that will be under the Supreme Court.
03:23The appeal from that will go to the Supreme Court.
03:26Because the Supreme Court is constitutional.
03:28For that, we, Vukla, worked very hard that under Article 184, you understand that there
03:32should be a separate court.
03:33But every court in this country will be under the Supreme Court.
03:37So look, the district judiciary is under the High Court.
03:41The Supreme Court is the biggest court and of all the courts.
03:44The constitutional status of the Supreme Court should not be terminated, sir.
03:47Otherwise, it will be terminated.
03:48You cannot make a Supreme Court and appoint judges of your choice.
03:52Sir, you tell me, if the judges of your choice, and those who are listening,
03:56that it is possible that the incumbent Chief Justice,
03:58the things that are being heard on your channel,
04:00because why is the age set for 68 years?
04:03That a retired judge or a judge who will retire from the Supreme Court of his choice,
04:07he will think that I will continue to work as a judge for the government,
04:10I will get three more years.
04:11I am also against that there should be a difference in the age of the judges of the High Court and the Supreme Court.
04:16Because when a judge becomes a senior, he is getting close to 62 years,
04:19the retirement age, he thinks that if I get elevated to the Supreme Court,
04:24then I will get three more years.
04:26So I am also against this.
04:28The age of both the courts should be equal.
04:30Even the Constitutional Court, which I say is under the Supreme Court,
04:34should also be 65 years old.
04:37So this is the thing.
04:39But the way they are,
04:41they have made the Supreme Court their home,
04:44and made the Supreme Court a civil court.
04:46So this cannot happen.
04:48And the Chief Justice will not be Pakistan.
04:49The Chief Justice will be the Supreme Court.
04:51And Article 209,
04:53which is your article,
04:55how a judge has to be judged,
04:59Article 209,
05:01in that the majority is given to the judges of the Constitutional Court.
05:04So whoever comes,
05:05the High Court,
05:06because his performance is not good,
05:08he will be going to the Supreme Judicial Council.
05:10The rest of the judges will also be going there.
05:12So see, by doing that,
05:14the rest of the judges will be released.
05:16Then, transfer of judges between courts.
05:18Sir, this used to happen in the time of martial law.
05:20Do you remember?
05:21And it was finished in the 18th amendment.
05:23In those days, a judge used to do a good job.
05:25When I came to practice,
05:27before that, Ajmal Mian Sahib,
05:29who later became the Chief Justice of the High Court
05:31and the Chief Justice of the Supreme Court,
05:33his son was sent there.
05:34Justice Abdul Qadir Chaudhry was there,
05:36who later became the Chief Justice.
05:37And then went to the Supreme Court.
05:38Both the deceased.
05:39He was sent to Karachi.
05:41As a punishment.
05:43Let's see if the Supreme Court takes up your petition.
05:47Thank you very much, Abbas Zubairi.
