00:00Right now, at least, seems like D.A. Gascon is trying to fast-track this, and now it's
00:08in the hands of Judge Ryan.
00:12Do you feel like it's being rushed so that it gets done before you're in office?
00:17Yes.
00:18The timing is incredibly suspicious.
00:20In fact, the original habeas motion was filed in May of 2023.
00:25The resentencing request was submitted in February of 2024.
00:29So if Gascon truly believed that the menendeces should be resentenced, he's delayed eight
00:34to 16 months in making that decision.
00:37And since there is no deadline in filing a resentencing request, he could have filed
00:42it on November 6th, 7th, or 8th after the November 5th general election.
00:47By filing it 12 days before that election, when he's 30 points down in the polls, and
00:52there were headlines that came out recently that said that a double murderer got out of
00:57prison in four years because of Gascon's policy and murdered again, he has basically
01:02used the menendez case as a made-for-TV media event to distract voters' attention from his
01:08record of public safety failure.
01:11And that is very, very obvious by the timing of when he is doing all this.
01:16When the D.A. said that—acknowledged that public interest generated by documentaries,
01:24the Netflix series, had an impact here in getting this—moving up the date to actually
01:33have this resentencing, to file for the resentencing, your reaction to that?
01:39My reaction to that is that the D.A. is gaslighting the public when he says that.
01:44Again, he had that resentencing request fully formed in February of 2024.
01:50We had the habeas with all the new evidence that they have alleged to alter what should
01:56be the verdict in this case back in May of 2023.
02:00If Gascon truly believed that resentencing was appropriate, he could have made a decision
02:058 to 16 months ago.
02:08So this is clearly—the timing is clearly politically motivated.
02:12And again, I don't know one way or the other whether or not the ultimate recommendation
02:16is appropriate, but I will if I have to make that decision after a thorough review.
