Suspect in UnitedHealth murder to fight extradition to New York

The 26-year-old man accused of gunning down UnitedHealth executive Brian Thompson in Manhattan intends to fight his extradition to New York to face murder charges from Pennsylvania, where he was arrested, his defense lawyer told a judge at a hearing on Tuesday December 10.

The suspect, Luigi Mangione, was also denied bail for the second time, a day after he was taken into custody at a fast food restaurant after a sprawling five-day manhunt.

He faces gun and forgery charges in Pennsylvania and was arraigned in Altoona on Monday. An arrest warrant for Mangione filed on Tuesday in Manhattan criminal court listed one count of second-degree murder, three counts of criminal possession of a weapon, and one count of criminal possession of a forged instrument.

While the gunman's motive remains unclear, police have said Thompson, the CEO of one of the nation's largest health insurers, was deliberately targeted.

00:00The judge gave 14 days for the defendant to file a petition for Habeas Corpus challenging the extradition,
00:09and he gave us 30 days for us to procure a governor's warrant from New York,
00:14which is the legal document necessary to effectuate the extradition.
00:20What is the strategy for Habeas Corpus? Is there one?
00:25Well, it simply gets the inevitable started sooner.
00:31We're going to do what's necessary to get the governor's warrant.
00:37We're working with the New York City Police Department and Manhattan DA's office,
00:42and we're going to get the defendant up there so they can prosecute him on their charges.
00:46So waiving accelerates that process.
00:50Contesting it just provides more hoops for law enforcement and prosecutors to jump through,
00:55but we're happy to do that.
00:57Were you disappointed?
00:59Well, they have 14 days to file a petition for Habeas Corpus,
01:04and that would simply be a document challenging the Commonwealth's ability to prove
01:10that the defendant is the person that the state of New York has issued the arrest warrant for.
01:15But that has nothing to do with the ability to be able to go out on bail,
01:21to be free on bail in the meantime.
01:23So for now, I mean, how much long is the bail denied all the way until trial?
01:28Well, this defendant now has two dockets in Blair County.
01:31One docket will go away once he is extradited, and that is his fugitive from justice charge,
01:37and the judge denied bail on that until, obviously, the judge makes a ruling on any defense motions,
01:43at which time we anticipate the state of New York will be able to collect the defendant.
01:48The other local charges, the encounter between the Altoona Police Department and the defendant,
01:54the defendant has been denied bail on that case as well,
01:57which the Pennsylvania Constitution provides for when the judge finds it appropriate under the circumstances.
02:03So your main goal right now is to have him extradited to New York?
02:06That's what you're working towards?
02:08Our primary focus is to cooperate with the New York City Police Department
02:11and Manhattan District Attorney's Office so this defendant can be prosecuted for his New York homicide charge, yes.
