The Home Ministry did not receive any orders from the Prime Minister’s Department’s Legal Affairs Division on allowing Datuk Seri Najib Razak to serve the remainder of his prison sentence under house arrest, says Datuk Seri Saifuddin Nasution Ismail.

At a press conference in Putrajaya on Monday (Jan 6), the Home Minister clarified that his ministry only received a letter outlining the board’s decision to halve Najib’s prison sentence from 12 to six years and reduce his fine from RM210mil to RM50mil in the SRC International case.

Saifuddin dismissed claims that his ministry refused to enforce a house arrest order, noting the addendum was never communicated to the Prisons Department.

00:00The purpose of this media conference is to provide a healthy perspective from the KDN
00:15on the issue of the decision of the Embassy of Independence over Datuk Seri Najib.
00:23The embassy that was operated by Dukat Tuanku, Pahang at that time,
00:32was established on 29 January 2024.
00:38And on 2 February 2024, the KDN, especially the Prison Department,
00:50received a letter from the Department of Justice of the Prime Minister's Office,
00:58which is the Secretary in the Embassy.
01:01The letter contains two things.
01:06First, it includes the minutes of the meeting,
01:10which is referred to as the reminder of the minutes of the meeting.
01:15That is, all discussions, all decisions,
01:21which are directly in the Embassy of Independence,
01:24are recorded as minutes of the meeting.
01:28That is the first thing given to us.
01:32The second is the order given to the Prison Department.
01:44This order means as an order to implement the decision of the Embassy of Independence.
01:56I cannot share the minutes of the meeting because it is a big secret.
02:01But it is important for the media to understand the perspective.
02:06The order is important.
02:08Because the order is the decision of the Embassy of Independence.
02:12And the order is signed by the head of the Embassy of Independence.
02:21The head of the Embassy of Independence.
02:25In this letter, he refers to himself as the head of the Embassy of Independence.
02:32In this order, which is signed by the head of the Embassy of Independence,
02:40he gives the background of the case that was passed by Datuk Sinajib.
02:48The decision of the High Court, the decision of the Court of Appeal,
02:51and the decision of the Court of Association.
02:54At the end of the letter, the background is as follows.
03:02Therefore, by the will of Sultan Abdullah Ria'an Yatuddin Al-Mustafa Billah Shah,
03:08son of the late Sultan Haji Ahmad Shah Al-Musta'im Billah Kebahduli,
03:13the 16th High Court of Appeal,
03:16in carrying out the power vested in me by the 42 embassies
03:22and all other powers that allow for that purpose,
03:26it is by this order that Datuk Sinajib bin Tun Haji Abdul Razak
03:31was released on the date of early release, 23 August 2028,
03:37and the fine was reduced to 50 million ringgit.
03:41If the fine was not paid,
03:44the prison term for Datuk Sinajib bin Tun Haji Abdul Razak
03:48was added for a year and the release date was 23 August 2029.
03:54This is important.
03:56The decision was to reduce the prison term and reduce the fine.
04:04This is a letter that the prison department received.
04:09This means that there is no mention of house arrest.
04:14So, as a prison department that carries out this order,
04:19ordered by the head of the embezzlement agency,
04:22together with the women who were involved,
04:25the prison department must abide by it.
04:31And that is what we are doing.
04:34So, it is important to have a clear perception
04:39that domestic violence, especially in the prison department,
04:44should not be or should not be measured.
04:47It is far from hiding any decisions made by the embezzlement agency.
04:54That is a very important fact.
04:56We are not involved in this.
04:58We did not receive the letter.
05:00This is the only letter that we received.
05:03I will tell you the important order.
05:0529 January is the meeting of the embezzlement agency.
05:092 February,
05:12a letter from the secretary of the embezzlement agency, Bahiu,
05:16signed by Dr. Punita.
05:20Dr. Punita Silivaraju.
05:23This letter is for the law enforcement.
05:27It is divided into two parts.
05:28The first part is the minutes.
05:30So, when we look at the minutes,
05:32it is similar to what the AGC has explained today in court.
05:37That the matter is not in the minutes.
05:40That is also what we have in KDN.
05:43The second part is the order to carry it out.
05:45That is important.
05:46The decision of the embezzlement agency must be carried out.
05:49By whom?
05:50In this case, by the prison department.
05:53If in the order of implementation,
05:58the decision is included,
06:01such as house arrest,
06:04it becomes our responsibility.
06:05But what I read clearly,
06:08it only involves two things.
06:10Reduce the prison term.
06:12Reduce the fine.
06:14The failure to pay the fine is added another year.
06:17That is what actually happened.
06:21We can share it with the media.
06:32Because the letter received by KDN,
06:36especially from the prison department,
06:38only mentioned those two things.
06:41How can we implement the order that is not in the order
06:46of the decision of the embezzlement agency?
06:50That is what we have in KDN.
06:53That is what we have in KDN.
06:55So if we are asked,
06:57that KDN does not carry out house arrest,
07:01we must carry it out
07:03based on the order of the embezzlement agency.
07:08The order is signed by the head of the embezzlement agency
07:12and the regional minister.
07:13Whether or not KDN, especially the prison department,
07:16implements it differently from the government.
07:18The Japanese can't do it.
07:20The Japanese can't do it.
07:21For example, reducing the prison term
07:24until 23 August.
07:26That is the order that must be carried out
07:29by the prison department.
07:46I am not disputing.
07:47I am stating a fact.
07:49I am not disputing.
07:56No, I reserve my comment on that.
07:58I am not a member of Paduan Board.
08:00Whatever I read from the media report,
08:05news report,
08:06including this morning,
08:08about the letter from the Pahang Palace,
08:11this is what I know about.
08:16The Pahang Palace has not issued any royal addendum to you?
08:21No communication with them?
08:22No, no communication.
08:24Okay, so I would like the Home Ministry
08:26coming up now to explain that.
08:29Because today in court,
08:31it was said that KDN concealed
08:36and did not carry out the decision of house arrest.
08:40That is not true.
08:41So of course, we need to show and explain.
08:44In the trial in court,
08:48Tansi Syafiee said that
08:51KDN, specifically the Home Ministry,
08:54did not carry it out.
08:56In his view,
08:59the house arrest order exists.
09:02He said.
09:03But today, I said that
09:06we can only carry it out
09:08in accordance with the black and white order
09:10that has been issued.
09:11Moreover, this order was signed by
09:14the head of the Home Ministry.
09:16Who is the king, right?
09:17This is the king.
09:18The head of the Home Ministry was the Sultan Abdul Aziz Shah?
09:21Yes, the king.
09:22He was the one who signed this document.
09:24But did you mention the addendum in the minutes?
09:26In the minutes, I did not read it.
09:28How was it mentioned by the AGC this morning?
09:31Remember, in here,
09:32what I cannot share is in the minutes.
09:34That is why it is a big secret.
09:36Of course, I previewed it.
09:37So it is not there.
09:38How was the argument of the AGC in the court today?
09:41That there is no extension.
09:45Because the AGC is a representative in the Pardon Board.
09:48So when the AGC announced today
09:51that in the minutes of the Home Ministry,
09:53there is no case of house arrest,
09:55then he argued in court like that.
09:57It is in accordance with what we have received.
10:00The order that was given,
10:03the initial release order,
10:05was because the term of imprisonment was reduced.
10:08That is it.
10:10How did you implement the addition?
10:14Because the AGC did not accept the addendum.
10:16No.
10:17No.
10:18This government,
10:20this government only has these two things.
10:22When was the date?
10:23February 2.
10:24Who sent it?
10:25Bahiyu.
10:26Who signed it?
10:27The government,
10:28the head of the Home Ministry,
10:29and the regional minister.
10:30What is the content?
10:32Two things.
10:33Because other than those two things,
10:35there is no case of house arrest.
10:37So if it is said that the AGC is hiding it,
10:40not implementing it,
10:41it is not true.
10:42The AGC cannot implement it,
10:44other than the government.
10:46The government is the decision of the Pardon Board
10:52that must be implemented by the prison department.
10:58So that is what we implement.
11:01So with this agreement,
11:03it means that there is no problem at all
11:05with the KDN or the government
11:08not implementing TITAH TUANGKU.
11:11We implement TITAH TUANGKU completely.
