00:00Welcome back to TMZ live ASAP Rocky's assault trial continues here in LA but
00:06his defense team has made a big decision he will not take the stand and that's
00:15typically what happens right that whoever's on trial it's very risky to
00:22take very very risky and especially I think in this case if you if you we if
00:29you could talk to his defense I think they feel pretty confident about how the
00:33trial has gone up to this point that there have been a lot of points where
00:38they've been able to raise some doubt and and their whole line the whole
00:44strategy about the fact that they say this gun was just a starter pistol was
00:49not could not fire any bullets that were gonna actually do any harm to ASAP
00:54rally they seem to be making some in some inroads they may well be making in
01:01roads but it is so unsurprising that he's not taking the stand it is such a
01:05risky move because you do that and on cross you open yourself up to everything
01:11and you make one really damning statement against your interest and it
01:17could sway the jury so it's it's so high risk and especially if you feel like
01:24you're you know all you have to do is create doubt and you win and if they
01:29feel they're in that territory why play with dynamite yeah defendants taking the
01:35stand in their own defense is only done as a Hail Mary really you know I don't
01:39know what the percentages are Harvey I've got to think that 95% of cases do
01:43not involve the defendant testifying for him or herself it would be a real sign
01:48desperation of course the fact he's not testifying doesn't necessarily think
01:52they're more confident I agree there have been some really good facts for
01:54them that have come out in the case but you never know but it way too risky to
01:58put him on the stand yeah you remember when ASAP rally was on the stand Joe
02:04Takapino it was a lawyer right lawyer well it was cross-examining ASAP rally
02:09the alleged victim and really had him on the ropes had him you know sort of
02:15second-guessing some of the facts that were presented so I think Takapino
02:21probably feels like we're doing well here plus don't forget the Rihanna fact
02:25I was just gonna say that Rihanna for several days not every day but several
02:30days she was there she's been there quite a bit yes a lot more than I
02:34thought she was going to be and she has been sitting there right behind him
02:37difference I will say though it could be the worst moment of the trial was when
02:40ASAP Rocky audibly instructed a was it a separately not to answer a question was
02:45not a separately was another member of the ASAP mob but it was someone he was
02:49friends with and yeah on the stand that was crazy jurors hear stuff like this
02:55you never really know what's going to tip a juror one way or the other there's
02:58a really bad moment they hear things and like why is this guy instructing a
03:02witness not to answer a question and it didn't seem particularly relevant it had
03:07to do with an insignia on a bedsheet with these letters the letters on what
03:12they meant he it's like what what does that have to do with whether he fired
03:17this gun at all but I think the prosecutors knew that he was good that
03:22ASAP 12e was the guy who was on the stand that he wasn't going to say it
03:26because this is and I didn't know this until that moment happened in the trial
03:31and I went and looked up a WGE that was the letters they were asking about it's
03:35an agency that that ASAP Rocky formed and when you go to the website it
03:40literally says rule number one never tell anyone what a WGE stands for so the
03:46prosecutors it's Fight Club clearly knew that the witness wasn't going to
03:51answer it and the witness wanted to show the witness stonewalling and maybe even
03:55bait Rocky into saying don't tell him what it is well I don't know how they
03:58baited him who would think that the defendants gonna say don't answer that
04:02question and it's like oh my god I actually have a different theory I
04:08think he's more guilty by saying those words on the stand by telling his partner
04:13or his buddy not to say those words I think it looks guilty and so I think he
04:16should testify at his own trial I mean I don't know if it was me I would be like
04:22put me in coach I got to state my case I'm not guilty I'm innocent
04:25rally is way more important and relevant than bet cheat right right just way more
04:31right and the exactly even though it doesn't look bad I think ultimately the
04:36jury's gonna look at it go like well what relevance that really that's right
