00:00The National Prosecution Service of the Department of Justice
00:04submitted to the office the recommendation of the NBI to file two complaints against Vice President Sara Duterte.
00:10This is what Rod Lagusan reported.
00:14After the investigation, the National Bureau of Investigation submitted its recommendation
00:19to the Department of Justice to file three counts of grave threat and inciting to sedition against Vice President Sara Duterte.
00:27Because of this, the second president, President Ferdinand R. Marcos Jr.,
00:32First Lady Liza Araneta Marcos,
00:34and House Speaker Martin Romualdez, are in charge.
00:36The ball is now in the DOJ.
00:38They will determine if they will conduct a preliminary investigation
00:45and later file a case in court.
00:49The DOJ will evaluate if the evidence that we submitted,
00:57our investigation is sufficient to conduct a preliminary investigation.
01:03If the DOJ can find prima facie evidence that they will have self-interview and conviction,
01:13they will file a case.
01:15This is what Vice President Sara Duterte said in an online press conference last year.
01:21According to the Department of Justice,
01:23it was submitted to the office of the National Prosecution Service.
01:26According to Prosecutor General Richard Padullon,
01:29it will undergo an evaluation to determine if the evidence is sufficient.
01:34If it is complete, the DOJ will start the preliminary investigation of the complaint.
01:40Although they did not get to know what Vice President Sara Duterte ordered,
01:44the NBI is firm in their case because they have sufficient evidence against Vice President Sara Duterte.
01:49It should be noted that the NBI invited Vice President Duterte
01:52when he agreed to meet with the President,
01:54but he did not attend because the NBI is under the DOJ.
01:58According to Santiago, Vice President Sara Duterte could be called by the DOJ
02:02or other witnesses.
02:03He said, the punishment for each count of grave threat is 12 years in prison.
02:08Because it was committed through cyber.
02:1712 years?
02:18Yes.
02:19Because this is the only penalty.
02:21For example, if you use cyber,
02:25the penalty is one degree higher.
02:29That is our law.
02:31The threat to the President was incited by his followers,
02:41by other people,
02:43as if they want to rise up.
02:45It is up to the DOJ to decide if both cases can be filed,
02:49one here, or both can be dismissed.
02:51Rod Laguzad for Pambansang TV in Bagong, Philippines.
