NEW YORK — The lawyer for a New York City teen who suffered severe lacerations when a police officer slammed him into a glass window is demanding that the case be reopened so that justice can be served.
Javier Payne and a 13-year-old friend were outside a hookah store on Arthur Avenue in the Bronx when they stopped to ask a man for cigarettes. When the man refused, Payne punched him in the face.
Responding police officers quickly handcuffed the two teens.
It's difficult to see in the security camera footage, but while a handcuffed Payne and his friend were standing in front of the store's window with one officer, another officer, Sergeant Eliezer Pabon, paced the street in front of them.
In the footage, Payne appears to have said something to Pabon, who rushes over and slams into Payne with his left elbow, smashing the 89-pound teen face-forward into the glass. Glass entered Payne's lungs and heart when his body hit the window, and he required four hours of emergency surgery to remove the glass from his body.
The Bronx District Attorney didn't file criminal charges against Pabon or present the case to a grand jury because, according to the New York Daily News, a glazier had told prosecutors that the window wasn't shatter-resistant and was likely compromised before Payne smashed into it.
With a new district attorney coming into office, Payne's lawyer hopes to get a different verdict.
Payne may have been a 14-year-old unruly punk, but that definitely didn't warrant him having his face and chest smashed straight into glass.
