Former premier’s son found guilty of fabricating evidence

A court has found the police officer son of former senator and New South Wales premier Krisitina Keneally fabricated evidence with the intent to mislead a judicial tribunal and landing a wrongly accused man behind bars.

00:00 25 year old policeman Daniel Keneally was working a night shift at Newtown Police Station
00:06 in February 2021 when he took a phone call from Goulburn man Luke Moore.
00:10 Moore was ringing to complain about police strip searches, but Keneally later wrote a
00:15 detailed statement where he claimed that Moore had threatened police.
00:18 In the statement he said the caller had named a specific Goulburn detective, saying he wanted
00:23 him dead, gone and off the face of the planet.
00:27 Moore was charged with using a carriage service to menace and threatened to kill and spent
00:31 three weeks in custody before he produced a recording of the phone conversation proving
00:36 that he had not said the things that Keneally had claimed.
00:39 Police were forced to drop the charges against him and apologise and instead they later charged
00:43 Keneally with one count of fabricating evidence with intent to mislead a judicial tribunal
00:48 in October last year.
00:50 The Magistrate today did not accept Keneally's explanation that he had become mixed up and
00:55 did not deliberately write false things in the statement.
00:58 Outside the court his lawyer said that he would be appealing the decision.
01:02 Mr Keneally holds his head high.
01:04 This won't be the last that we've heard of this particular matter, but again we respect
01:10 the court's decision but can say that the matter after sentencing will definitely be
01:14 appealed on the basis that my client, which I firmly believe, never willfully put something
01:21 in a statement that he knew to be false.
01:23 It's a very high hurdle for the prosecution to prove and all I'll say at this stage is
01:28 we respect the court's decision but of course the beauty of our system is we have an appeal
01:33 right.
01:34 Keneally will return to court in December to be sentenced.
