00:00 Supreme Court has given a very big decision.
00:02 It is a landmark judgment in Pakistan's history.
00:05 And there is criticism on it.
00:07 But this landmark judgment is because a political party has now gone out of the race for the election before the election.
00:14 So, in the upcoming general election, more or less, the trends will be decided in the context of this decision.
00:23 What is this decision?
00:24 This decision says that the Supreme Court has declared the Peshawar High Court's decision as 'Kaladam'.
00:28 And has taken back the electoral mark of the PTI.
00:31 What is worth noting here is that this decision was unanimously announced.
00:36 This decision has come to the public's attention since 3-0.
00:39 In the leadership of Chief Justice Qazi Faiz Issa, three Rupni Benches participated.
00:43 Justice Muhammad Ali Mazhar and Justice Musarrat Hilali were included in the bench.

00:49 On 8th June 2022, the PTI held the elections.
00:51 But according to the election commission's decision on 13th September 2023, the PTI failed to hold transparent elections.
00:58 Instead of following the section 215/5 of the Election Act, the PTI filed a request to the Lahore High Court.
01:04 On the request of the PTI, five Rupni Benches were formed in the Lahore High Court.
01:07 On which the matter is under investigation.
01:09 During the request to the Lahore High Court, the PTI held the intraparty elections on 2nd December 2023.
01:15 The PTI held the elections again but did not take back its request to the Lahore High Court.
01:20 After the intraparty elections, the election commission received numerous complaints.
01:23 On which the PTI was issued a notice.
01:26 On the request of the PTI, the Peshawar High Court asked the election commission to decide on intraparty elections by 22nd December.
01:32 In Peshawar High Court, the PTI did not state while filing the request that such a request is under investigation in front of five Rupni Benches in the Lahore High Court.
01:40 If one matter is under investigation in one High Court, then the other High Court cannot be challenged.
01:44 On 22nd December, the election commission said that the PTI did not hold the correct elections.
01:48 And took back the election signatures from the PTI.
01:51 The PTI accused the election commission of discriminatory treatment.

04:23 this was a flawed legal strategy according to your decision.
04:28 It is better that our legal team answer this question.
04:33 But, as far as I have understood and I have information on both the bases,
04:38 I can say that for a long time, particularly since our party was removed from the government,
04:45 we were not getting justice from the courts.
04:47 We were trying our best to approach the avenues where we could get justice.
04:54 If this is against any legal practice, I cannot comment on that.
05:00 But, we went to the forums and tried to get justice from there.
05:06 On a couple of occasions, particularly from Peshawar High Court,
05:09 we appeal that they have made the right decision.
05:12 As far as the Supreme Court is concerned, we did not go to the Supreme Court.
05:15 The Election Commission of Pakistan went there.
05:17 Ultimately, they had to come.
05:19 It kind of reflects also on the state of the judiciary in the country.
05:23 As Mr. Hamid Khan has said, it is a pity that the courts are making decisions against the law and the requirements of the constitution.
05:34 It seems that they are propelled by an agenda.
05:37 There are two points in this.
05:38 Both these things cannot be mutually exclusive.
05:41 One is that the elections of Pakistan Tariq-e-Insaf were not transparent as per the constitution.
05:50 The second is that this is a very controversial decision.
05:53 It is not in the interest of a greater national interest to remove a popular community before the elections.
06:00 But if the people of the city were cruel, you would have also wanted to die.
06:04 If you had made the elections appropriate, this opportunity would not have come.
06:07 We strongly feel and our belief is that these elections were done in accordance with our constitution.
06:13 In the same way, all the other political parties,
06:17 I have challenged the Election Commission on two other programs
06:21 to show us the election results of any political party,
06:24 which is different from this.
06:26 There are single panel elections, where everyone is in the same way, in half a room.
06:30 Why did we go to Peshawar?
06:32 We wrote a letter to the Election Commission to provide us with security.
06:36 We wrote to the Islamabad administration to provide security.
06:40 The Election Commission wrote a letter to them under its covering letter in Islamabad and a few other places to provide security.
06:48 We were not provided security.
06:50 We were only committed to providing security in Peshawar.
06:55 That was the reason we went to Peshawar and held the elections in Chamkani.
06:59 The rest of the preparatory work was done in the Central Secretariat.
07:05 It was in Islamabad. I used to sit there.
07:08 We collected all the nominations.
07:11 Everything came and the panel was made.
07:13 It was Mr. Khan's panel.
07:15 No one was ready to stand against Mr. Khan's panel.
07:17 The Election Commission told me that our constitution was violated there.
07:22 There were 14-16 people who came to the court and testified that they wanted to participate in the elections.
07:26 We were not allowed to participate.
07:27 This is our fault. I was sitting in the party office.
07:30 We had time till 3 pm.
07:34 We had to collect our nomination papers.
07:36 At 4.45 pm, Akbar Babar Sahib came there with a few of his coworkers and a few cameramen.
07:44 It was not 4.45 pm.
07:46 It was past 3 o'clock.
07:48 Even after coming there, he did not express his desire to collect the nomination papers.
07:55 He was never interested in taking part in the elections.
07:57 He came there, recorded the videos and then left.
08:01 That is what he did.
08:03 This is the reality that I am talking about.

08:07 So, it is wrong of him to say that he wanted to participate in the elections.
