The prosecution has made a preliminary objection against an application by Toh Puan Na'imah Abdul Khalid who is challenging the validity of the charge against her under the Malaysian Anti-Corruption Commission (MACC) Act.

In an affidavit-in-reply affirmed by Deputy Public Prosecutor Maziah Mohaide, the prosecution said there was no necessity for the Sessions Court to refer the constitutionality of Na'imah charge to the High Court as the application had no merit.

00:34 Minister Tundim Zainuddin, had no merit.
00:37 According to Mazia, Section 36 of the MACC Act 2009 is a provision that authorises MACC
00:45 officers to obtain information for investigation purposes.
00:49 She also said the provision also does not violate Article 8 of the Federal Constitution.
00:55 Meanwhile, during the mention of the cases against Naima and Daim in the Sessions Court
01:00 on Friday, Judge Azura Alwi set May 21 to hear Naima's application.
01:05 The judge also set May 9 for mention of a similar application filed by Daim.
01:10 On January 29, Daim pleaded not guilty in the Sessions Court to three counts of failing
01:15 to comply with a notice to declare his assets, which include several luxury vehicles, companies
01:21 and properties.
01:23 On January 23, Naima was charged with a similar offence, and the assets include Manara Ilham
01:29 and several others in Kuala Lumpur and Penang.
