00:00TH Heavy Engineering Berhad was ordered to pay more than RM440,000 after the industrial
00:08court ruled in favour of a former senior executive's claim of constructive dismissal.
00:14The finance ministry owns a 64.45% stake in THHE through its wholly owned subsidiary Uruz
00:21Harta Jamaat Sindiran Berhad.
00:24The court heard the case ex parte after THHE's representatives were deemed unauthorised to
00:29appear.
00:30Malik Rahim, THHE's former Group General Manager of Finance, who was awarded compensation
00:36after the company unilaterally imposed pay cuts, failed to compensate for additional
00:41work, demoted him and blocked his access to work systems.
00:45The court found THHE's defence, including the impact of the COVID-19 pandemic, insufficient
00:51to justify their actions.
00:53Kuala Lumpur Industrial Court Chairman Iswari Mari said the company's conduct breached fundamental
00:58employment contract terms, damaging the trust and confidence in the employment relationship.
01:04Malik had protested the pay cuts and demotion, and after being excluded from key functions
01:09and ignored, he considered himself constructively dismissed.
