00:00The Industrial Court has held that Malaysia Airport's Sandirian Berhad was wrong to dismiss
00:08its employee on grounds of misconduct after having condoned the act for which he was sanctioned.

00:17Lin Anthony said the company should have dismissed Aminuddin Kamaruddin immediately if it considered
00:22the misconduct to be of a serious nature.
00:26In allowing the ex-flight security staff member's complaint of unfair dismissal, J.C.
00:31Lin said the company never suspended Aminuddin after finding out about his misconduct.
00:37Instead, they only counseled Aminuddin and secured from him an undertaking not to violate
00:44its rules and regulations.

00:48Lin awarded Aminuddin a net sum of R36,363.60 in back wages and compensation in lieu of
00:55reinstatement, having deducted 30% of the total sum due on account of the claimant's
01:00contributory misconduct.
01:03Aminuddin had negligently released a female passenger without proper documentation at
01:08KLIA's International Departure Hall checkpoint on December 7, 2019, and admitted to breaching
01:15regulations and callousness when issued a show-cause letter.
01:20Despite this, Aminuddin was told that investigations into the incident would continue, and he was
01:26subsequently issued three additional show-cause letters, dated July 8, September 15, and November
01:3212, 2020, before being dismissed on March 10 the following year.
