00:00Assalam-o-Alaikum and good evening, I am Meher Bukhari.
00:15In the last round of the case of £190 million, the Islamabad High Court has stopped the trial court from making a final decision.
00:20And in the case of Audio Leaks, the Supreme Court has stopped the Islamabad High Court from further proceedings.
00:25In the case of 14 days judicial remand, the former Prime Minister Imran Khan and his wife have been arrested.
00:32Imran Khan had filed a request in the Islamabad High Court three days ago to stop the trial of £190 million case.
00:38Today, the Division Bench, consisting of Justice Mia Gulhassan Aurangzeb and Justice Babar Sattar,
00:42has agreed to the request with the objections of the Registrar's Office.
00:46During the hearing, Imran Khan's lawyer, Salman Sardar, said to the court that 35 witnesses have been referenced against Imran Khan.
00:52The last witness is being referred to the Prosecutor's Office.
00:55In this case, there are eight accused, six acquittals and two cases against husband and wife.
01:00The real accusation is to the extent of Property Tycoon's family that they are acquittals.
01:04The allegation is that when Imran Khan was the Prime Minister, he filed a case of £190 million.
01:12The money was to come to the State Bank, but it came to the Supreme Court's account.
01:16This settlement was between Property Tycoon and NCA.
01:20NCA has given the money and they can use it wherever they want.
01:24Lawyer Salman Sardar said to the court that Imran Khan and Bushra's wife have been accused of Al-Qaeda Trust case.
01:29In this case, Imran Khan was arrested.
01:32In this case, NAB initially filed a reference against eight accused.
01:36The court declared the other six acquittals as acquittals.
01:40According to NAB, NCA has seized £190 million.
01:44Justice Gulhasan Aurangzeb questioned whether the money went back to Property Tycoon and his family's account.
01:50The lawyer said that the money was sent directly to the Supreme Court's account.
01:55Justice Gulhasan Aurangzeb again questioned whether the money was returned to Property Tycoon and his family by the UK.
02:02And from whose side was this money sent to Pakistan?
02:05The lawyer told the court that the money was returned and this money was sent by Property Tycoon's family.
02:10And to make Imran Khan Al-Qaeda Trust, land was also given.
02:13Justice Gulhasan Aurangzeb asked where is this university?
02:16And is it functional?
02:18The lawyer said that the university is in Jhelum.
02:20458 acres of land is now in the name of University Trust.
02:23During the hearing, Lawyer Salman Sardar also requested the court to request a record of NAB Executive Board meeting.
02:32But the trial court rejected our request to request a record.
02:35And the trial court judge wrote surprising reasons and said that the investigation officer is not the author or custodian of this record.
02:42Justice Gulhasan Aurangzeb once again questioned that how many requests did you make?
02:47The lawyer said that he had only made one request.
02:50After hearing the arguments of Lawyer Salman Sardar, the court has stopped the trial court from making a final decision.
02:56The court issued a notice to NAB that Imran Khan's son should not be used in the trial court.
03:04If he is used in the trial court, the court will not only take back his name, but will also issue an order to make a decision soon.
03:11Former Prime Minister Imran Khan filed a request in Islamabad High Court on 16 August.
03:17He said that in April 2020, NAB had requested to close this case in the Executive Board meeting.
03:24The investigation officer also admitted some facts.
03:27And despite asking for a record of this case, the judge withdrew the request.
03:30After hearing Imran Khan's request, the court has stopped the trial court from making a final decision.
03:36This case has entered the last stage.
03:38The investigation officer is the last witness of this case.
03:41And he testified a few weeks ago.
03:43But the defense lawyer could not complete the sentence on various grounds.
03:47Along with the ruling of Islamabad High Court, the Supreme Court has also stopped the Islamabad High Court from further proceedings in the case of Audio Leaks.
03:54On the appeal of the loyal government, the Supreme Court has condemned the decision of Islamabad High Court to be a breach of powers.
04:01On 29 May, Islamabad High Court issued a decision on the request of Bushra Bibi and Najm Saqib against Mubayana Audio Leaks.
04:08In this decision, Islamabad High Court issued an order to allow telecom companies to access the data of phone recordings and listeners and also to stop the use of it.
04:17Any form of surveillance of the citizens was declared illegal.
04:21The government challenged this decision in the Supreme Court.
04:24And in the leadership of Justice Ameenuddin Khan, two Rukni Bench closed the case.
04:27At the beginning of the closure, Justice Ameenuddin Khan questioned that has the High Court decided who is recording the audio?
04:34On this, the Additional Attorney General replied that it has not been decided yet.
04:38During the closing, Justice Naeem Akhtar Afghan remarked that unfortunately, no one wants to reach the truth in this country.
04:45To know the truth, an inquiry commission was formed and it was given a stay by the Supreme Court.
04:50The case of Audio Leaks has not been decided in the Supreme Court yet.
04:54When the Parliament tried to know the truth, it was also stopped.
04:57Neither will the Parliament be allowed to work, nor will the court.
05:00Then how will the truth be revealed?
05:02After that, the court accepted the appeals of the loyal government and issued notices to Najm Saqib and Bushra Bibi.
05:09The Supreme Court has issued an order that Islamabad High Court cannot proceed with the proceedings of the case related to Audio Leaks.
05:15The High Court does not have the right to take a notice.
05:18In the case of Audio Leaks, along with this important development, Bani PTI and Bushra Bibi have been sent to jail for judicial remand.
05:27During the closing of Adiala Jail, the High Court decided that Imran Khan has been included in the investigation.
05:33The written statement has been handed over to the investigation team.
05:36And the written statement of Bushra Bibi has also been handed over to the NAB team.
05:39The NAB initiated further physical remand.
05:42The court ordered both the accused to be presented in court on September 2, and sent them to jail for 14 days for judicial remand.
05:49In the case of Hiddat Nikah, Imran Khan and his wife were arrested in the new reference of this case.
05:56And this new case is related to keeping ten valuable copies of Khilaf-e-Qanoon and then selling them.
06:03After the presentation in Adiala Jail, former Prime Minister Imran Khan had an unofficial conversation with the journalists.
06:10And he brought some revelations to the public.
06:13According to Imran Khan, Faiz Hameed is being made a witness against me.
06:17All this is being done to take me to the military court.
06:20General Faiz Hameed is trying to say something that there was a conspiracy.
06:25Imran Khan said in a conversation with the journalists that the conspirator does not demand the judicial commission.
06:30The regime change was against us.
06:32I was put in jail.
06:34The journalist asked Imran Khan to always defend General Faiz.
06:38Now that he is arrested, why do you think he will become a witness?
06:42Imran Khan replied that he does not care.
06:46If he gives any testimony against me, I am saying that he was negotiating with the Taliban for three years.
06:53He should not have been removed.
06:55And I also told General Retired Bajwa not to remove him.
06:58If you go to the military court, what will happen to the party?
07:02The party is already having more and more disagreements.
07:06In response to this question, Imran Khan said that our party is getting stronger every day.
07:12The people have given their decision on February 8.
07:14He is standing with his decision.
07:16Imran Khan said that there is a limit to the journalist's one more question.
07:19It is being said that Faiz Hameed used to give instructions to Bushra Bibi.
07:22Imran Khan said about General Kamar Javed Bajwa that General Retired Bajwa has stolen my back.
07:28He made a deal with Nawaz Sharif and removed Faiz Hameed from office.
07:33Wafaaq-e-Wazir-e-Itilat is claiming that General Retired Faiz Hameed was behind this conspiracy.
07:42Wafaaq-e-Wazir-e-Itilat is also claiming that Imran Khan and Faiz Hameed colluded.
07:50There are many people other than Niazi and Faiz who colluded.
07:54There are people from other institutions as well.
07:56Faiz was Murshid's client.
07:57Faiz was not Murshid's, but Faiz Hameed's.
07:59This has caused a lot of damage to the country.
08:02If this project had not been launched, Pakistan would not be in this situation today.
08:08It is being said again and again that this was a false flag operation in 9th May.
08:12This was not a false flag operation.
08:14This operation was made by you.
08:16The perpetrators of this operation go to your Faiz and Niazi nexus.
08:22How was this facilitated?
08:24A political party was tried to run by staying behind.
08:28Imran Khan and General Faiz Hameed are being held accountable for their actions against Muslim League Noon.
08:34General Retired Faiz Hameed apologised to him in October.
08:37This is being said about General Faiz Hameed and Justice Saqib Nisar.
08:42Some sources are claiming that Faiz Hameed and Saqib Nisar were in contact.
08:47Hukam has received some evidence against former Chief Justice Saqib Nisar.
08:51More investigations are being done on this.
08:53Former President Dr. Aryeh Farbi was asking for Article 6.
08:56Today he was saying that the government should look into Article 6 and fulfil its wish.
09:00I am here.
09:01There are still many difficult cases left for us in this battle for justice.
09:07There are dozens of cases under serious charges.
09:10And the government is facing more difficulties due to not being in contact with other institutions.
09:14Today, the government minister Barista Aqeel was also announcing that the doors of negotiations on justice are closed forever.
09:22More and more nexuses are emerging from all these investigations on foreign funding.
09:27There will be more arrests.
09:29Any kind of attack on Pakistan.
09:31Any kind of harm to Pakistan.
09:33Neither Fajr Pakistan, nor us politicians, nor any other institutions will tolerate this.
09:38Now, there will be no talks of any kind.
09:41Now, there will be no negotiations of any kind.
09:44The political people, the organized groups that are harming Pakistan.
09:49They have no right to get political space in Pakistan.
09:52They have no right to do politics in Pakistan.
09:56We have with us, the former minister of justice, the senior leader of Tehreek-e-Insaf, Babar Awan.
10:01Mr. Babar, thank you very much for being with us.
10:03Sir, please tell us, Imran Khan is talking to the media in Adiala Jail about his apprehensions, reservations, and so-to-say insecurity.
10:14He is being threatened to be transferred to a military court.
10:20Is this a threat to him, sir, or is this a bad news for your leader?
10:26I don't think it's just a threat, Mehar.
10:30The reason for this is that three types of cases have been made.
10:34One was of anti-terrorism.
10:37They were not able to punish them.
10:38The second was of treachery or rebellion.
10:42They were not able to punish them.
10:43The third was of mistrial.
10:45The first appellate court dismissed all those punishments.
10:49That's why the real issue is simple.
10:55When there was desperation from all sides, after General Faiz was arrested, there were indications.
11:01Before this, you may remember, an incident was made in the jail.
11:05Imran Khan confessed his crime.
11:07Imran Khan took a bath in his boat.
11:10They told me that.
11:11I clarified it there as well.
11:13That's why this apprehension is not the only thing left.
11:17Secondly, you should listen to the ministers of the government who are responsible for promoting this.
11:24They are saying that there is a relationship with them.
11:27First, they said that Pasha ran PTI.
11:30Then they said that Zaheer was running it.
11:32After that, Tareem was going to run it.
11:34Then you say that General Faiz is running it.
11:38That's why it is very rubbish.
11:40This is a very dangerous thing.
11:42They should not move forward in this way.
11:44Before this, they also tried to take a decision from the Punjab government.
11:51They also tried to take action on Article 6.
11:54That's why this is not a misnomer.
11:56This is not a threat at all.
11:59This is a well-placed apprehension.
12:06Sir, you are the lawyer of PAI.
12:09If General Faiz's character is proven in the planning of 9th May,
12:13how dangerous will it be for Imran Khan?
12:15Can Imran Khan be included in General Faiz's trial?
12:20What can General Faiz have to do with 9th May?
12:24Has he been informed about the people who came to arrest him?
12:30We don't know yet.
12:31That's why we can't take anyone's name.
12:33They said that they will arrest him today.
12:35After that, this will happen, this will happen, this will happen.
12:38Imran Khan went there to get his biometrics done.
12:41That's why there was an incident in isolation.
12:45And the abrupt result that should have come out, came out.
12:48People were worried that if they are dragging him like this,
12:52then I don't know what to do.
12:54And then Supreme Court of Pakistan also took notice of it.
12:58That judgment is also present.
13:00That's why this is a very far-fetched idea.
13:04Even if it is far-fetched.
13:19This does directly implicate Imran Khan.
13:33That he has proven himself to be a criminal in terms of his confession.
13:37There is no inculpatory value for anyone else.
13:41This is the judgment of the Supreme Court of Pakistan.
13:43And there is a judgment on it by the big courts of the world.
13:46Now come to the second, can he be dragged?
13:49You will remember a lawyer,
13:51whose litigation was going on for the family.
13:54Between his father and his mother.
13:57His father died there.
14:00In Balochistan, Quetta.
14:02In that case too, he was dragged.
14:04And then he will have to face the consequences.
14:06Tell us, why does the Supreme Court not give a final decision
14:09in the military court of civilians regarding the trial?
14:12The final decision is already there.
14:15Which is present in the case of Sheikh Liaquat Ali.
14:18Do you remember?
14:20MKM Ghaliban and some other organization.
14:238 people were sentenced to death.
14:26And after that, the Supreme Court of Pakistan gave a judgment.
14:29This is a new series.
14:42This was the era of Nawaz Sharif.
14:45On this new movement.
14:54The majority has come forward.
14:58Security of a person.
15:01His life and body.
15:20This is their responsibility.
15:23They cannot abdicate this.
15:26To remove the nation from this situation.
15:29I take advantage of your question.
15:32I want to demand from the Supreme Court of Pakistan.
15:35Immediately.
15:38Put the whole Supreme Court on it.
15:41This is a very important issue.
15:44The vote decision has not been finalized yet.
15:47The process of the election in Pakistan has not been finalized yet.
15:50This is something that will never be finalized.
15:53I want to remind everyone.
15:56No harm should be done to the safety of Imran Khan.
15:59No harm should be done to the safety of Imran Khan.
16:02These people will directly attack their country.
16:05And their survival.
16:18He is the only person who does not fear in Pakistan.
16:21Five minutes after retiring, he came to Belgium.
16:24Five minutes after retiring, he came to Belgium.
16:29He has his people in his cells.
16:32He has his rights.
16:42Article 14 states.
16:45No legal action is taken against him.
16:48of man, there can be no legal action against him, and this is not Pakistan, nor Burma,
16:55nor is it North Korea, where there is a judicature, and here is a constitutional country, how can
17:01civilians be trialled, that you are a Kani, a man has retired, there are people who are
17:07sitting in office and people accuse them of taking part in politics, then the debate will
17:13be over, and if you ask me as a person, as a Pakistani, as an ordinary citizen, then
17:20it is a matter of great concern for me, that the agency which we consider to be the prime
17:26agency of the world, and if we find out that the 6 years that he was in office, he was
17:31corrupt, he was a traitor, he was very dishonest, then what is happening, what is the government
17:37doing, should they be concerned, or should they stop somewhere in the agency?
17:42Sir, his internal agency is investigating, the government is not doing it, nor was it
17:48announced by the government, although the Ministry of Defence could have done it, the
17:52Prime Minister could have done it, but neither this news was shared by them, nor this decision
17:57was taken, so the investigation should be done in advance, but Mr. Behar Kaif, today
18:03a question was asked from the former Prime Minister, that as a Prime Minister, you did
18:07not get the right army chief, you did not get the right DGI, you did not get the right
18:12office boy, so what were you the Prime Minister of? This question is of great importance,
18:17sir, some lessons, do you think that your Jamaat, and especially Imran Khan, have learnt
18:22that if you get a position with so much helplessness and so much lack of powers, then perhaps
18:27there is no benefit to it either?
18:29This is not called lack of power, this is called local conspiracies, this can be called a parallel
18:34system, this cannot be called lack of power, where they asserted, I will give you four
18:39examples.
18:40And while being in the government, you used to call it the same page?
18:44I will give you four examples, first, how they asserted in COVID-19, second, when it
18:49came to Modi, they themselves addressed Modi, they are not even ready to take Modi's name
18:54even after the water, who are sitting presently.
18:57They said that if you come, you will be beaten.
19:00Third, they went all over the world and talked about Islamophobia.
19:03Fourth, they said to big powers that our money is in your center, we are returning money
19:08to poor countries, what more bravery can anyone do than this?
19:12Second, as far as teaching lessons are concerned, we do not need to teach lessons, we are a
19:18political party.
19:19We do our introspection more than many people.
19:23Some of them even come out of it.
19:26In other places, they are not allowed to talk, they are not allowed to talk.
19:30What a family does is just their policy.
19:33Therefore, in my opinion, the objective that will be my answer is that at this time, all
19:38these rumors that are going around, do these rumors have anything to do with the economy
19:43in the country?
19:44What is the news of tomorrow, which is Gharfat-ul-Dubai, which is called the Chamber of Commerce
19:50and Industry, it said that in the last six months, more than 3,900 Pakistani companies
19:55and firms have chambered.
19:57I think in the last ten years, no one has taken a membership in our own chamber.
20:02So do you want to take the country forward?
20:05Do you want to take revenge?
20:07Do you want to accuse?
20:09Do you want to make accusations?
20:11If you say one thing, then you can go.
20:14Nothing will work like this.
20:17And you put three comments.
20:19First you bring Mr. Shahbaz.
20:21Then you will be a long, yes, first the economy will be fine, then the election will take
20:25place.
20:26And then you will bring him again at the same time.
20:28So is the economy, is anything at any place?
20:30Ask anyone if anything is right.
20:32Answer would be no.
20:33So what are we doing with the country?
20:35If the common man knows that the country has fallen into the pit of destruction, the country
20:39has been thrown into the ditch, what will be the way to get it out?
20:43More accusations.
20:44More cases.
20:45More accusations.
20:46More media trials.
20:47More abuses.
20:48That we will not leave.
20:49We are being challenged.
20:50We will not leave.
20:51You said that the institution is doing introspection.
20:53That is welcome.
20:54But who is speaking?
20:55The minister is speaking.
20:56That we know that, one said that I know what individual crime is.
20:59The second said that I know what conspiracy is.
21:01The third said that I know who is involved and who is not.
21:04I am not talking about merit.
21:07I am not talking about merit.
21:09I am not talking about merit.
21:11I am not talking about merit.
21:13I am not talking about merit.
21:15I am not talking about merit.
21:17I am not talking about merit.
21:19I am not talking about merit.
21:21I am not talking about merit.
21:23I am not talking about merit.
21:25I am not talking about merit.
21:27I am not talking about merit.
21:29I am not talking about merit.
21:31I am not talking about merit.
21:33I am not talking about merit.
21:35I am not talking about merit.
21:37I am not talking about merit.
21:39I am not talking about merit.
21:41I am not talking about merit.
21:43I am not talking about merit.
21:45I am not talking about merit.
21:47I am not talking about merit.
21:49I am not talking about merit.
21:51I am not talking about merit.
21:53I am not talking about merit.
21:55I am not talking about merit.
21:57I am not talking about merit.
21:59I am not talking about merit.
22:01I am not talking about merit.
22:03Secondly, there is a doctrine
22:05that has been going on in Pakistan
22:07for the past 78 years.
22:09You can call it
22:11the principle of law.
22:13It is the
22:15doctrine of realist pendants.
22:17All the courts in the world
22:19do the same.
22:21If you have a dispute
22:23and we go to the court
22:25and the court says
22:27that I don't give a stay
22:29and you decide
22:31then all the litigation
22:33will be redundant.
22:35will be redundant.
22:37And to avoid redundancy
22:39the doctrine
22:41that I have just put in front of you
22:43is accepted in the whole world.
22:45Pakistan is a strange country
22:47that first we will not give a stay
22:49and then we will say that
22:51the decision has been made
22:53and you can decide.
22:55Third and most important thing
22:57is that
22:59it is a vested right
23:01and it is a right on a large scale.
23:03In that case, me and Raja Anwar were lawyers
23:05and Benazir Bhutto and Asif Zardari
23:07had a case
23:09in which the Supreme Court of Pakistan
23:11has decided
23:13you may remember
23:15the tapes
23:17Malik Kajum Maroombali
23:19they have decided
23:21that if there is a question of bias
23:23and they have said it in three ways
23:25in someone's prudent mind
23:27whether I am a litigant or a lawyer
23:29I think that justice cannot be done
23:31I can move
23:33and on the first priority
23:35the judge should recuse himself
23:37and an independent, fair, free, transparent trial should be done.
23:39The second is
23:41that from a word, a spoken word
23:43it is called an arbiter dicta in the language of law
23:45if it affects the team
23:47then the judge or the court
23:49should immediately desist from listening to the case.
23:51Third and most important thing is
23:53that if somewhere
23:55there is something written
23:57which is considered to be harmful
23:59what is the law of asylum in the world?
24:01In the case of death
24:03they say that we give you asylum immediately
24:05if there is a false FIR
24:07and it goes against you
24:09So you are saying that you will have
24:11many steps to challenge this
24:13if there is a trial in the military court and a decision is made
24:15No, I think
24:17it should not go that far
24:19my Supreme Court of Pakistan
24:21That is a different thing
24:23You should not think that
24:25Imran Khan has already filed a request
24:27but if it is done
24:29you do have other avenues
24:31of getting justice
24:33according to yourself
24:35We have avenues of fight
24:37we get justice
24:39let the bridge come
24:41and we will know what is happening
24:43but we expect a free trial
24:45from the court
24:47it is not an ordinary trial
24:49We listened to your conversation
