00:00This is the type of indictment you would expect from someone in the mafia.
00:03I don't know that I could keep him off the stand.
00:05He is very eager to tell his story.
00:08They're going to show that video over and over and over
00:11about what happens to women that won't change their stories.
00:15His reputation is over.
00:17The United States government, they start making this case
00:20as a takedown of a successful black man.
00:24TMZ presents The Downfall of Diddy, The Indictment, now streaming on Tubi.
00:30Well, it is now Diddy making the allegations against the feds,
00:34and a pretty serious one involving that Cassie beating,
00:38the hotel beating video, and how it ended up at CNN
00:43and then out for the public to see.
00:46Diddy and his team believe that the feds played a big role in it coming out,
00:51and they are alleging in new documents they filed,
00:55they are alleging that the reason the feds were involved in this
00:59was to ensure that, was basically to dirty him up so the grand jury would,
01:04is basically to soften up the grand jury so he would be indicted.
01:07So what they're arguing is that Homeland Security,
01:10according to Diddy's lawyers,
01:12that Homeland Security, they believe, leaked this video.
01:16And as Charles said, it is to poison,
01:20that at least they claim that it was to poison the grand jury.
01:26It is an interesting argument.
01:28I don't know how they're going to prove that,
01:30but it's kind of an interesting argument,
01:32because the Cassie video, as horrific as it is,
01:37is not part of the criminal indictment that Diddy is now facing.
01:43She is mentioned, but mentioned in connection with...
01:47I disagree.
01:48Well, no, I mean, legally, it's not part of it.
01:51I know he's not being prosecuted for the beating itself,
01:54but there is a mention of him holding her against her will,
01:57and it is very clearly referring to that morning at that hotel.
02:01It doesn't align with the charges, and I think it underscores...
02:04No, no, holding her against her will,
02:06people against their will is one of the charges, is in the indictment.
02:08But it's not about that video.
02:10They're not arguing that video.
02:12No, they're not.
02:13So then the question is, look, I mean,
02:16they put it in there because obviously it is just incendiary to watch,
02:20but what they're saying...
02:20I guess my point is that video would have been shown to the grand jury anyway.
02:24Well, it may not have been shown to the grand jury
02:27because it's not really relevant to the sex trafficking charges
02:32and the other charges.
02:33There is a charge holding people against their will.
02:35But they're not charging...
02:37Kidnapping.
02:37They're not charging based on this.
02:40That's the...
02:41Do you know what the kidnapping charge is based on?
02:43I know it's not this,
02:43because we've checked with the people involved in this.
02:47I think what's happening here,
02:48it's an effort by Diddy's counsel in doing his job
02:51to seize the narrative, the public narrative,
02:54and to make it seem like the federal prosecutors
02:57are overzealous in the prosecution of Diddy
02:59and being unfair to him.
03:00Because it does appear that the...
03:02Assuming they released it,
03:03which is something that they have not acknowledged,
03:05and other people probably had access to this,
03:07but assuming they released it,
03:08it does appear that it was an effort to, at the very least,
03:12turn public sentiment against him
03:13and maybe even taint the grand jury.
03:15I do think, to Charles' point,
03:16the prosecution is going to try and get this video in regardless...
03:20It's going to be part of the trial,
03:22but it's going to be part of the trial
03:24to show his MO and his character.
03:27We did a documentary,
03:29The Downfall of Diddy, The Indictment,
03:30where we actually talk with Diddy's lawyer about this,
03:34and his lawyer acknowledges,
03:36we may try to fight to get this thing kept out,
03:39but we're going to lose it.
03:40I mean, he essentially said it.
03:41So the jury is actually going to see this video,
03:44but they're going to see it not to prove the charges
03:48as much as to show the man,
03:50and that's why, and even the defense says,
03:53we're not going to be able to keep that out.
03:55Yeah, so I think Charles' point has some merit,
03:58that the grand jury is likely to see this,
04:00but it doesn't change the fact, I suppose,
04:02that the reason that the prosecutors,
04:05the U.S. Attorney's Office put this out early
04:07was to try and sort of poison the well,
04:10both of the grand jury and the public against Diddy.
04:12We don't know, though.
04:13Again, we don't know if they did.
04:15We don't know.
04:16Let's be honest, if they did,
04:18they're never going to acknowledge it,
04:19and I don't know how Diddy proves that they did.
04:23I don't either. I don't either.
04:25By the way, as we speak right now,
04:27there's a hearing going on in this case,
04:29and the prosecutor said that there may well be
04:33a superseding indictment with more charges.
04:36The U.S. Attorney talked about this
04:39when they announced the indictment
04:40and even said there might be other people indicted as well,
04:44and that's a big buzz in Hollywood right now,
04:47which is, you know, who might be involved,
04:50and are there going to be more charges against Diddy?
04:52Hey, Harvey. Hey, Charles.
04:53It's Daniel from Brooklyn,
04:55and I just want to say, like, sorry, Harvey,
04:58but lawyers, you know, like,
04:59they're going to do anything to make their clients
05:03seem like it's the law enforcement against them,
05:08you know, but we know that there is so much more
05:10to this case than that tape.
05:12This man is a monster, clearly,
05:14and yeah, it's possible the feds could have leaked it,
05:16but like you said, that's not the entirety of the charges,
05:22so there's a lot more things Diddy has to deal with.
05:25I think this is more to rebuild his fan base.
05:27Well, I'm not sure that fan base exists at this point.
05:30Yeah.
05:31It's going to be rough to get it back.
